How does one transfer a vehicle either a car or motorcycle ownership in Malaysia?

Before proceeding further, permit me to inform you that Section 13 (1) of the Road Transport Act 1987 reiterates that a driver has to make the necessary transfer of vehicle within a period of 7 days after buying or selling of a vehicle.

Failing to do so entails a RM100 fine!

But making a transfer of ownership can be rather a difficult endeavor.

Why do we need to transfer the ownership of a vehicle?

One of the reason is when a family member passed away and the next of kin would like to sell off the vehicle.

Below is a video interview I did explaining the process of transferring a vehicle ownership of a deceased family member.

Ownership transfer challenges

A friend of mine, Mr. Ong sold his jalopy some 18 years ago.

Rather recently, Mr. Ong came to seek my assistance.

He laments, the car which he sold a decade ago it yet in his name still.

The story has it that legal action now is being taken against him.

The owner who bought the old car had not bothered to take the necessary steps to transfer the vehicle ownership.

Anyway, this has resulted in a gain for my friend.

In the recent rebate exercise, Mr. Ong went to the Post Office to claim his RM600.

Believe it or not, he was still the rightful owner of the vehicle after 18 long years.

In my opinion, many motorists do not know the correct procedures to adopt when selling a vehicle.

The procedure

What they normally do is:

i) Sign the JPJ K3 form (MV3) form.

ii) Provide 2 copies of their MyKad to the new owner.

iii) Hand the Registration card (blue book) to the purchaser or finance company and that’s about it.

They should in fact:

i) Inform in a letter to the Registrar of Motor Inland Vehicles (R.M.I.V) of the sale

ii) Inform the Police authorities of the sale too.

iii) Inform the insurance company of the sale as well.

Simple agreement

Ideally, a simple agreement should then be concluded between you and the purchaser of your car.

In it, state that as from henceforth, you are no longer liable for:

i) Any traffic offences that might be caused by the said vehicle.

ii) For any accident which might involve the vehicle which is registered under your name.

The simple piece of paper, which represents an agreement, should ideally also be stamped at the Stamp Office in your town nearby.

The total cost does not involve more than RM10.

This simple agreement above might not provide you full protection against legal actions, but believe me, it goes a long way.

But the point is, how many motorists and drivers know the procedures?

And yet, how many more bother about the hassle?

Unless you are like me, who is very interested in all things legal, and who possesses a Registrar of Companies for a brother, I believe most people will not bother too much about the correct manner to adopt when selling off an old vehicle.

This is where they get into trouble with the law.

Today’s article will therefore pay emphasis on how to transfer a vehicle.

Yes, the steps are many and time consuming, no doubt.

But instructing you on the proper way to get a vehicle transferred from A to Z will be worth the while.

It might very well assist you from being taken to court by some quarters, especially the law.

First, go to the nearest J.P.J. office.

Get a set of transfer forms needed. The forms will consist of:

i) JPJ TM-3 form – Borang Permohonan Pertukaran Milikan Kenderaan.

ii) JPJ K3A form – Transfer of ownership / Borang Penyata Pertukaran Milikan Kenderaan.

iii) Form to certify new ownership.

Fill up the form and sign it wherever necessary.

The new owner’s identification card or MyKad have to be certified by:

i) An officer of the Transport Department.

ii) A Commissioner of Oaths.

iii) A Justice of Peace of J.P.

iv) A Judge from the Session Court.

If you wish to save some money, you could go to J.P.J. office.

An officer there will help you certify the above documents.

Vehicle inspection

The next step after completing the transfer form is to bring your vehicle Puspakom inspection.

There is such a facility at Kampung Jawa, Klang.

The working hours are from 8:00 am to 6:00 pm.

Puspakom officials will conduct a 10 point check on your car.

Ideally, your car should be in a fairly good condition to pass the test.

Owners are advised to send their vehicle for servicing prior to sending them for inspection purposes.

Puspakom authorities will supply owners with a K5 certificate.

This certificate will then enable one to do the transfer of a car with the J.P.J. authorities.

Inspections can be completed around 1 – 2 hours.

Sometimes if delay occurs, it might take a little bit longer.

In case you wish to know, it costs RM35 – RM50 to do an inspection exercise.

Completion of Puspakom’s tests will lead you next to the following steps.

Insurance purchase

This is known as insurance purchase.

The new owner has to purchase new insurance in order to do the transfer.

Experience tells me, a RM8000 first party insurance will come to around RM550.

However, scout around.

Some insurance may charge slightly lower prices.

Having completed the insurance purchase, you are ready next to submit the transfer form to the J.P.J. for transfer.

A word of reminder though, the transfer itself requires a fee of RM100.

You can pay cash at the counter.

Make sure you check your Senarai Semak to see all the relevant sections of your transfer form has been duly completed.

Armed with all the above forms, go to the transfer section of any J.P.J. office to do your transfer.

You should face no difficulty at all.

Officials and staff of the J.P.J. are courteous, friendly and ever ready to assist you wherever they can.

As a reminder again, the transfer fee is RM100.

Transfer can sometimes be done within the day itself.

At times, the J.P.J. might need to detain your transfer documents in order to certify certain particulars.

That being so, the authorities might have to issue you with a photostat copy, duly signed by its officers for your temporary use.

You will be asked to come back later for your new registration card or vehicle card.

Runner service

To end this article, I wish to inform you that the service of a middle men or runner can be as much as RM450 – RM500 for such a transfer.

Should you think the amount is worth paying for such a job done, by all means, you could engage their services.

Considering the procedures one has to go through, my personal opinion is, I think it is worth all the hassle a middle man has to go through in trying to get your vehicle transferred.

He has to live also right?

    I bought a vehicle about 3yrs ago. I did not transfer because the seller was in hospital. It so happen that his health got from bad to worse and eventually he died. I have the original Reg card, copy of release letter from the finance, a letter from the finance company saying that full settlement has been done and that they have no objection to the transfer, copy of owner’s NRIC. I do not have signed copy of the transfer document from the owner and the certified copy of the owner’s NRIC. I can’t locate the next of kin. The car is an old car which I bought for RM6,000-00. Please advise me on how to get the car transfered to my name. Thank you.

      Your appear to have all the required documents for transfer. Transfer form JPJ K3A, which you can get from any J.P.J. office, needs to be signed by the owner.

      If the owner has passed away, I’m afraid you’ll need:

      i) Death certificate (copy)

      ii) Surat wasiat.

      Anyway, talk to the J.P.J. officials whether is it possible to waive the above requirements.

        I saw the form that was needed to transfer ownership of the vehicle in question, the TM-3 & K3A, and I noticed it was in Malay, and I was wondering if there’s an English version of those forms. Because I have extreme bad Malay, and I’m scared that because I can’t read it the person selling the said vehicle might try to con me.

    Hi sir, i need your advise on transfer of ownership. we have just bought a car manufactured in year 1985. We havent did our ownership transfer. But got the car inspected at puspakom and most of the insurance company has rejected us.

    So i went to UniAsia seeking help for the MMIP insurance which they said is available for us. *But he said it is being insured according to the name on the Original Red Card, which is still the seller’s.

    Note*Road Tax Expired. Stuck without Insurance & Road Tax. Can’t get insurance, can’t transfer ownership.

    -He said we will have to have the ownership transfered at JPJ before we can buy a new insurance. *they said it is insured according to the name on red card.
    -He said we can have the ownership transfered since the Road Tax has expired.
    -As we all know we can only transfer once we got an insurance right? is that what he is saying is true ?

    I am staying in KL off and on for the next year or so, (on a social visa so no PR, MyKad etc) and want to buy second hand motorbike / scooter for getting around.

    Is the process outlined above for cars the same for second hand motorscooters?

    And am I going to have any issues because I don’t have MyKad / PR or work visa?

    I need your help here…. i want to buy a used car for me to travel around and today i found a suitable car and i am very interested in it… and felt worth for the price but the owner tell me which is a pakistan said he never transfer the name of the car to his name as he buy from a chinese guy. He had the registration card and the insurance policy and he said he can give me all the document when i buy the car. The problem now is that the car is not in his name and how can i transfer the name to me… or any way to deal with the transferring issue??I really hope i can buy the car but the problem is he never transfer the name to his name. Need advise here….

      There are a few things you should be aware of. Vehicle which is in the Chinese man’s name and to transfer to your name, see to it that above’s i/C is available. Compare and ensure the vehicle is in the Chinese man’s name.

      The transfer form TM3 (Pin 1009) should be signed by the Chinese owner, and not the Pakistani. Ensure that the car you are buying has no encumbrances like ownership claim by finance companies.

      Finally, in my opinion, the problem to the above car you intend to buy has too many hassles. In short, in my view, you shouldn’t buy the car!

      Usual transfer procedures should ideally be followed. Amongst them:
      i) Inspection by Puspakom authorities.
      ii) Transfer of name / address of new of new owner into vehicle records.
      iii) Followed by proper purchased of insurance coverage speedily.

      The above 3 steps should be done ASAP.

      It should be reiterated that transfer of ownership be made as soon as possible. It’s therefore never advisable to do what you’re doing. However, the decision rests with you.

      Personally, I would advise you to wait till owner is back in Malaysia. Unforeseen hitches might develop which can very well hamper transfer procedures.

      Ensure your vehicle card is original. Get a release letter from JPJ that the vehicle is free from encumbrances. Also ask JPJ if the vehicle, which would be sent overseas, should be transferred first before it can be shipped overseas. Lave shipment preparation to buyer, who will look for above herself / himself.

      From look of things, no transfer has yet been made. Go to any state JPJ to check your car’s status. JPJ should be able to advise you what to do.

    Dear Sir, i am looking for a 2nd hand car and recently test drive one which i am very comfortable with. The problem is that, the current owner has not transfer the car under his name becuase he is a studying here. He bought the car about half a year ago and decide to sell it becuase he is leaving the country. The actual owner is a local guy and i have seen the owner card. To do a transfer to my name, what are the procedures that i can do? Can i asked for the car to be inspect at puspakom now to be verified fit for use then ask the person on the owner card to sign the release form?     Hello Mr. Cikgu, I have a simple question. My car’s ( Proton Tiara 1996 ) road tax expired last month. The car’s registration is still not under my name. Can I buy an insurance for my car and renew the roadtax without transferring the car to my name? The previous owner of the car who is my friend is currently outside the country, so I can’t get the transfer papers complete. Thank you for your advice in advance & also it would be helpful if you can tell me which insurance company would have the cheapest premium as u see my car’s market value is less than RM 5000.

      You can use the former owner’s name to get your insurance and road tax. Immediately transfer the vehicle to your name soonest possible. Buying insurance for a vehicle more than 10 years is a problem nowadays. However, you cold try the Post Office. Hopefully they could advice you.

      If you father’s car is a new car, still owing hire purchase, advisable to buy 1st party insurance for value of the car. If its an older model of vehicle, then you can purchase 3rd party insurance. Mode of buying, the same for both models.

    my old proton wira got reposessed by bank and they already lelong the car. and they send me a letter asking me to settle the remaining. so just to clear my name, i have cleared all the payment and settle everything.

      If the summons are after the date you sold the car, there’s a basis for you to fight against it. If after checking, you find the car still in your name, then you’re responsible for the summons.

      You can do the Puspakom test anytime. The inspection results lasts for 1 months approximately.

    Hi Cikgu,

    I went to Puspakom today to do the transfer of ownership check. It cost me RM30 and took 5 minutes.

    The 10-point check as outlined above was not conducted. I received a B5 certificate.

    Has there been a change in the procedure? I remember, back in 2007, they conducted a 10-point check on my car before the ownership was transfered to me.

      Ensure buyer can get a loan before handling over all documents. When all is in order, only then will the bank release the loan.

    i’m looking to buy a used car. The owner is at Sabah but the car at melaka. The owner has asked his fren in melaka to help dealing on car sell.

    My 1st questions is who should do the owner transfer? Am i rite to say that both parties(seller/buyer) can do it provided all the forms are duly signed and documents are certified?

    Second questions is, at which point of time shoud i (the buyer) make the payment (cash)? i reckon the following steps:
    1. seller did the puspakom check, buyer purchase insurance policy.
    2. do the agreements between seller & buyer as mentioned in ur article.
    3. buyer makes payment and request seller to write 2 receipts, drive the car back.
    4. Then either seller/buyer go jpj to do the transfer.

    Or should I make payment after the owner transfer?

    And my last question is how to inform the police of the sale?

      Either party can do the transfer as long as documents are duly signed. Your recommendations are all feasible. When payment is paid, depends on both your agreement.

      A motor that has no road tax for 8 years must undergo a Puspakom inspection. Like cars, I assume the inspection should be around RM30. I’m uncertain, but I feel the requirement must be the same as cars. Motircycle transfer, I’ve been told is RM3. Currently for motorcycle, a person should pay a nominal road tax fee of RM2. For insurance, you’ll to obtain “all rider’s policy” or 1st part insurance.

    I recently purchased a 2nd hand car and sold off my current ride to the used car dealer …
    Have already settled the current ride so .. no issue on it..

    As for the 2nd hand car I am planning to put my father’s name as this 2nd hand car owner…He is overseas and i doubt can make it back for the transfer…

    I’ve recently renounced my malaysia citizenship. I have a car in Malaysia registered under my name used by my family member. As the transfer of ownership to my family member would means forgo the 55% of NCD, is it advisable to keep my car without transferring ownership?       Yes, you’re correct. You’ll lose the 55% if you transfer it to your family member. You could allow the car to remain in your name. But make sure, whoever uses it should drive carefully.     i am in possession of a proton car, bought the car in KL without changing owners (Miss NH) name, continued paying the bank loan , car was installed with sunroof then the shipping agent done all paperwork with Customs and have it shipped to Kota Kinabalu, still pays every month bank loan here in KK under the owners name,

    my question is how do i go about in having the car registered to my name?

    do i get the car inspected by puspakom here firsts, do the bank loan settlement or apply for financing, then fly to KL and together with the owner (Miss NH) go to JPJ in Putrajaya to do the ownership transfer,

    will it possible to complete all procedure in KL in a single day or two perhaps if my schedule permits ,

    your suggestion and advise is highly appreciated,

      I assume the car is now in KK. Get the complete transfer forms and have them signed by both owner and seller. You can have the car inspected by Puspakom authorities in KK. After getting certificate B5, you can do the transfer at the nearest JPJ office in Sabah. Transfer need not be done in Peninsular Malaysia at all.

        From what I have read in your advice given to others, if I buy a car located in JB but which is registered in Penang and I have all the necessary documents, I can get it transfered at JB JPJ. Is that correct? It used to be that one had to request for the file to be transferred from Penang JPJ to the JPJ in JB.

          Correct, a vehicle registered in Penang can have its transfer done in JB. However, all necessary documents should be in order. Unnecessary to file transfer.

      If it is RM350 inclusive of transfer fee of RM100, it is a fair price. See that you name has been inserted into the registration card. For insurance, look for a good insurance company around town to assist you.

    Dear Sir,

    I need your advise. I’m in a situation where my husband has used my name to buy his car 2.5 years ago..the car is in 5 years loan. and so he have another 2.5 years to settle. I’m the owner of a second hand car legally whereby we bought it fr rm38k. I’m not using the car and he’s fully using it. I’m thinking of selling it to him without much hassles.

    Once he has been using it, he has altered and fixed NGV for the car but have not send to PUSPAKOM for inspection. Since I’m the owner and I’m sellin it to him, if I just only send to PUSPAKOM for inspection because when I sell they’ll check the car at PUSPAKOM right? Will they charge me any penalty for not doing the inspection earlier??

    Is there any scenario whereby I can just transfer the loan to his name and for him to continue the payment for the balance 2.5 years??

      A vehicle that has been altered to NGV has to be inspected by Puspakom authorities. If anything happens, as the registered owner, you’ll be held responsible. To transfer the car to your husband, I suggest you see a finance company.

      They are normally lurking outside the JPJ offices. My advice is save your money and try it yourself. JPJ offices are quite efficient now and their staff are friendly and customer-oriented.

    I am intended to buy the auction car from finance company. I read the term and condition on the auction and saying that we should perform double transfer instead of single transfer. Single transfer seem to have problem. What is “double transfer” and “single transfer” ?

    By the way, from the bank car auction, the previous owner will have pre-sign the transfer form to the bank. So, upon successful tendered, we shall get the documents from banker and it should not have the problem, right?

    But, sometime if the bank have misplaced or loss the document such as transfer forms. So, what should we do?

    Is it difficult to transfer ownership for auction car? Can you please give us the procedure for the transfer of ownership for the tender car since the seller is not present in this case.

    I am in Penang, selling my car to a buyer in KL. Buyer cannot come to Penang, arranging for someone to drive the car down to KL for him.

    I’ve obtained the list of forms and documents that I must bring to JPJ from their website.

    Questions:

    1. Does the buyer have to come personally to JPJ if we do the transfer in Penang?

    2. If the buyer cannot be present when I go to JPJ Penang, how do we do the ownership transfer so that the buyer is fully responsible for the car once I hand it over? (eg I would not want to be liable for any speeding tickets incurred while the car is being driven down to KL)

    3. Are there any other documents in addition to the JPJ forms (TM-1, JPJ K3, TM-AB) that I need to prepare in this transfer ownership situation where I may not meet the buyer face-to-face?

      Get all the required forms signed by the buyer. Buyer need not be in Penang. Don’t forget, you’ll have to do the Puspakom test before transfer can be done. Also, type out a separate agreement to state that the buyer will from hence be responsible for the car e.g. summonses, accidents etc before handling the car over.

    Need your advice here: I’ve an old (1993) car that I never got to have the finance company ownership cancelled by JPJ.

    Reason was the release letter from the finance co. was misplaced earlier and the whole issue was forgotten until recently when I intend to give away the car to my nephew. Problem is the finance co (MUI finance) is no longer in existent.

    Question is how do I get the MUI finance co ownership cancelled by JPJ on my registration card? Please help. Thanks

      As it is an old car, getting a release letter from a company that has wound up would be a hassle. Continue using the car under your name. Make sure you get the road tax and insurance coverage.

    We have 2 cars now, and planning to buy 3rd car.
    1st Car is on my wife name (with NCD 55%), and 2nd Car is on my name (with NCD 55%).

    My question if we purchase our 3rd car, how can we transfer the NCD 55% to the new car? If we can transfer the NCD, does it mean that my old car will restart the NCD again at 15%? What is the procedure involve?

      Both your NCB or your wife’s can be use to claim the NCB for the new car. The vehicle whose NCB is used will no longer have any NCB. It’s NCB will gradually build up again from year to year, beginning with 25% the following year.

    I originally bought a car under my friend’s company and now both of us would like it to be transferred to my company. It is still under HP. What is the procedure, I have been informed that Normally, banks do not permit the assignment of HP facilities for motor vehicles from one borrower to another. The bank would normally require:-

    1. The purchaser of the vehicle ) to apply for a new HP facility AND

    2. Execution of bill of sale between the vendor stating the purchase price for the car

    As this is a straightforward transfer do I have to reapply for a new HP facility or go straight to the originating bank and request them do the transfer? If so with what documents?

      Your observation are indeed correct. HP facilities for one owner unfortunately cannot be used for another party or person. Apply for a new HP for new owner. Then only can you facilitate a new transfer.

    I’d like to thank you first of all for this very informative blog on the procedures of transferring vehicle ownership and now to my situation…

    A relative of mine has for a few years now been using a car registered under an elder family member’s name. Recently it turned out that when my relative wanted to renew the insurance for the car to renew the road tax, the insurance company informed my relative that they would not renew the policy due to our family elders age (who is almost 80 and the registered owner of both vehicle and original policy).

    Now, the solution would be to transfer the ownership of the car to my relative and get a new policy. Unfortunately, my relative isn’t able to take up ownership of the car due to a certain set of circumstances and wants it to be transferred under my name. I am rather reluctant to go through with it as I am uncertain about the risks/responsibilities involved in owning a vehicle I wouldn’t be using.

    Although my relative is going to be footing the bill for the transfer and upkeep for the car, I am worried about any problems that may arise in the future and as I am still studying and with only a meager income I would prefer to avoid bearing the burden of unexpected expenses should anything happen.

    I would really appreciate any advice and opinions on this matter and also would like to ask if there are any other risks or liabilities involved in owning a vehicle that you know of apart from the ones you’ve already listed in the blog above?(ie traffic offences & collisions) Thanks again in advance Cikgu! =)

      In my opinion, there exists no reason for the insurance company not wanting to issue insurance coverage for a driver based upon his age, which is 80 years. A complaint can be made to Bank Negara regarding the above refusal. The question of transferring the above said vehicle to someone else in fact does not arise at all.

    The objective I writing this is seeking some advice from Cikgu with refer to the below outlined scenario:

    Someone told me that an OLD vehicle registration number is cannot be transferred to an USED vehicle but in the mean time another member told me that this can be done provided the current registration number on the used vehicle is registered on another vehicle.

    To make things clearer, I’ll telling you the scenario where I’ll be facing here:
    I got a 2-digit vehicle registration number on a motor bike registered on my name and I wish to transfer this 2-digit vehicle registration number to an USED car which I going to buy it soon. If the trick mentioned above works then all I have to do is just get the vehicle registration number on the bike and the USED car swapped right? Any other precautions that I should aware if I want this to be done?

      Numbers for old vehicles can only be transferred to newly registered vehicles. The new number has to be transferred to your old vehicle in return.

    My company’s car was newly bought in year 2006 May and this company is going to cease operation end of this month, June 2011.

    I am the company’s director and this car will be transfered to my name – I have been driving it since day one the company bought it.

    My question is, does this car needs to go through the Puspakom inspection too?

    You did mentioned that a 3rd party can do the whole process of transferring, where can I get a reliable source and are they normally reliable one? What are the key documents that I can pass to them? Do I need to follow them to the JPJ office?

      I assume the company car you are now using is currently registered under your company name. As you now wish to convert the ownership to your personal name, yes, the car needs to go through Puspakom test.

      The documents needed are:
      i) Registration card.
      ii) A certain deposit for runner to undergo Puspakom examination.

    For some particular reason, my father doesn’t have driving license and can’t have vehicle loan.

    Therefore, My father has bought and “using” a new car under my name. Recently I found that he got some summons under my name, I feel quite irritating.

    And recently, I need to buy a car for working transport purpose but I have met the car loan limitation after my father bought the car using my name.

    After talk to him, he says want to transfer the car’s name to my mother’s name. My questions are:

    1. My mum doesn’t work, doesn’t have driving license, can this works ?

    2. He says because this car purchase less than 1 year, so if transfer name now will need to buy car insurance again, will spend a lot, is this true? and how much will need to spend actually if i want to transfer name within 1 yr?

    3. What will happen if he keep making some traffic offence, how serious is it will effect me?

    4. If he can able pay the lump sum of the car balance, can he still transfers name to my mum if my mum doesn’t have license?

    5. Can you give me some other suggestions for my problem?..thank you a lot!

      Normally, a person without a license can not be allowed to own a car. The rule is practiced by some finance companies. True, a car which undergo ownership must buy new insurance which is rather costly.

      As long as the summons is paid faithfully, there shouldn’t be any problem. Your father should refrain from getting in accidents. The only advice I can give you is by the new car by cash and register it in your name.

      Firstly to change your brother’s car to your name requires a new agreement to be made with the finance company. Your first step should therefore consult the finance company. They will then advise you the steps to be taken.

      Transfer are same between siblings. Please read the article above carefully. Then do a Puspakom test to get a B5 certificate. I suggest you get a good runner to assist you.

      Either settle the loan fully or draw up a new installment loan. New and old owners need not meet, but the documents required and necessary forms have to be signed by all parties concerned. Your motorcycle has to go through a Puspakom test too.

      Usually, buyer does the transfer. Likewise, buyer responsible for Puspakom inspection too. Transferring normally under the 5 points inspection to get B5 certificate, not 18 points inspection.

    Need your help over here. I’m in KL. I sold my car in 16/04/2011 to a person who claimed he is buying for his wife (but later i knew he is 2nd hand car dealer, and I think it could be possible that he is buying for his wife).

    I did prepare a simple memorandum stating clearly my name & NRIC, his name and NRIC, vehicle model, engine no., chasis no., year of the car and vehicle registration number.

    And also stating the price sold, and stating what I have handed over to him and putting down the date and time hand over. I also state that any fines before the particular date and time will be my responsibility and after that is his responsibility to pay the fines.

    I also put he have to complete the change of title within 4 week.

    Now I received a letter from Majlis Perbandaran Seberang Perai that I have 1 compound unsettled date 09/06/2011.

    I have call the buyer and he said he sold to a reliable buyer. He said he will check.

    While waiting for his reply, I hope you can give me some advice.

      There is a maxim, “trust nobody but yourself”. The car you sold is obviously still in your name. Settle MP Seberang Perai summons quickly or you’ll get blacklisted.

      I understand currently, the law requires a person to possess a driving licenses if you intend to enter your name as owner of a vehicle. You might ask around and try to find ways to overcome this problem. As they say, “nothing is impossible”.

    Currently I drive a car which registered under my brother name; and now my brother wish to transfer the car ownership to me since he already bough another car.

    Now my problem is:

    My brother have to come personally to JPJ office during sign off all the documents? but I’m staying at Penang and my brother at KL, it’s not convenient for him travel to Penang just for this matter.

    I do contact with a runner and He said that the car ownership tranfer can be done without my brother signature on any documents and need not come personally to JPJ office.

    It’s possible doing like that? it’s legal?

      Read the article above again and find out what documents needed. Sign all the relevant forms needs. Also provide your IC photocopy to your brother in KL and have him signed them. A good runner should then be able to help you. However, your runner’s suggestion your brother need not sign the documents appear is against the law and therefore illegal.

    Good day, I have question. Iam an expat and due to the type of job I have, I need to leave the country soon. To cut it short, I still have a 2000model RX300 car and I cant find any buyer yet. The sad thing is I have to move out of the country in 2 days time and I have to leave my car to my colleague.

    Now my question: Is there anyway I can transfer the car to any buyer without me physically in Malaysia. If yes what should I be preparing before I go.

      Read the article above again and find out what documents needed. Sign all the relevant forms needs. Also provide your photocopy passport / visa documents to your colleague. You need not be here physically. A runner or colleague can do the transfer / inspection for you at Puspakom.

    I have renounced Msia citizenship 2 yrs ago and this month is my last installment of my car. The road tax expired 5 days ago. I would like to transfer the ownership to my hubby.

    I need to bring my car to Puspakom for inspection but no valid road tax.

    If i renew the road tax and insurance now and my hubby again insured the car during the transfer of ownership this will cost a sum of money.

    What is the procedure in this case?

      Transferring your car to your hubby can be done. I suggest you get a good runner to assist you. The runner or you yourself can apply for 1 day special road tax to bring your card to Puspakom for inspection purposes. In doing the above, obviously you’ll have to get a special coverage for insurance too. Indeed all of the above will be a little bit of a hassle and certainly will cost money.

    hi my car was stolen end of last year but i didnt bother to make a report because its a very old car. i am buying a new car now but i still have my saman for the old car even though it was stolen. i am going to the jpj to transfer name of the new car to may name. will there be a problem in name transfer if i have not paid my old saman?

      Immaterial whether it’s an old car or otherwise, the correct procedure is for you to make a police report immediately. If you have not done so, do it immediately! Ideally, settle your old saman first.

    I am a Malaysian citizen recently returned from the US where I obtained my US driver’s license from an American state. I also have an international driver’s license, also from the US, that is valid until June 2012. I am interested in buying a car for RM21,000 that is still under loan by the current owner.

    1. Can I own and register the car given my driver’s license details?

    2. What do I need to do about the seller’s outstanding loan before buying and what documentation do I need?

      Firstly, get your American IDL converted into Malaysian license before you can register your name for the vehicle you intend to buy. Then you’ll have to work out a new loan agreement for the vehicle you wish to purchase. The finance company will let your know the documents needed.

    I sold my 1979’s toyota car four years ago without transfer of ownership. The new owner refused to change ownership as he claimed that the car would not pass the PUSPAKOM’s inspection because the engine was modified.

    Hi Cikgu Yap,

    I’m from a Sdn Bhd company & I’m trying to sell one of our company car to an internal staff. I would like to check with you in regards to the documents involved & the procedures.

    I currently have the following documents:
    1) JPJ K3 form (signed by company director)
    2) JPJ TM-AB (signed by company director)
    3) Photocopy I/C of the company director that signed the JPJ forms
    4) Company Forms 9,24 & 49
    5) The vehicle grant
    6) Director’s Resolution

    Do I still need to obtain the Borang Semak & the form to certify new ownership? What other documents do I need to sell of company vehicles?

    Do I still need to go to Puspakom, JPJ, Session Court, the Commissioner of Oaths?

    The staff that is buying, is very familiar with the vehicle already.

      Please read the article above carefully on procedures of vehicle transfer. The Borang Semak is important that it assist you to recheck all the requirement required. Vehicles for transfer must under Puspakom 5 points check. The MyKad particulars of the new owner must be certified by a Commissioner Of Oath or a JPJ official at any JPJ office.

    Dear Cikgu Yap

    Indeed an informative site & commend your effort to share your knowledge to the community.

    I have sold my car 2 days back.
    The car was bought in cash so there is no loan.
    I sold it to a used car dealer.
    When i asked him to do JPJ transfer, he said they will only do it when they find a new buyer. Could be soon, could be years.
    Since the car is under my name until they find a buyer, i’m worried that it may collect summons & I could be blacklisted if they take it for a joy ride…

    What are the forms that I have to fill to inform the police & JPJ that I have sold the car and no longer responsible for any summons?

    I have the bill of sale for the car & letter from the insurance that I have cancelled the insurance. Are all these sufficient?

    Appreciate your advice so that it may benefit other forumers with my dilemma.

      You will be responsible for summons / traffic offences even after you sold the vehicle, as long as the vehicle is not transferred. The only way out it o draft a simple agreement and have is signed by both parties. Have it stamped to make it legal.

    I do have a registered Singapore scrambler motorcycle(I m the legal owner).I hv got all the info on how to de-register the bike in Singapore.
    I would like to know the procedure for me to register the bike in Malaysia.

      Please visit Customs Malaysia’s web site on how to bring a used vehicle into Malaysia. Approach the above department to see if you qualify to be given special treatment as an individual. After you have managed to get your vehicle here, you will then have to approach the JPJ to get their permission / forms to register your bike with the authorities.

    My father wanted to get rid of his old car which was not in driving condition. We got one friend to tow it away and also gave him the reg card for transfer.

    But the car was not transferred and we don’t know who has got the car now.

    What should we do? So far, there are no summons or legal matters but we don’t want to take any chances.

      You should ideally have kept the registration card, not give it away Try getting back the above card if possible. It can be a source of much problems later on.

          As last resort, you’re advised to make police report. Tell the police the real situation and that you’re afraid the registration card would be misused. Then send a registered copy og the report to JPJ, your last insurance company and the local council where you reside. The above action might safeguard your interests to a certain degree later on.

    Will like to seek your advise here. I am planning to buy a car from a direct owner. According to him, he bought the car in cash and therefore does not service any loan. My question is, how do i verify this? I intend to buy cash from him as well.

    Do i look at his car registration card? If so, what should i be expecting/or not expecting to see?

      Get hold of the registration book. Lot at it carefully. Ensure the owner is your friend. See if there is any ownership claims by either a bank or finance company. Also, if your friend has bought the vehicle for cash, then he should be in possession of a cash sale receipt too. You are further advised, unless all the above is in your favour, then only can the cash amount payment be made.

      Are you ready to accept the dealer’s suggestion? Don’t forget, you’ll be responsible for summons in future as long as the vehicle is in your name.

But now he is requesting a copy of my last insurance policy, according to him this is the document required for ownership transfer. Is this true?       The insurance policy is yours. Whether you allow the dealer usage of the above policy depends solely on you. The used car owner should get anew policy for the vehicle he has purchased from you.

    Hi, Great website with a lot of useful information.
    I’m an expat who is about to leave the country for pastures new and therefore need to sell my car. I’m a bit concerned about this as I’ve never sold a car even in my home country so don’t want to get ripped off or come back in a few years to find many summons against my name! You mention not using an agent to help with the paperwork, but will I be able to easily find the right person to help at JPJ and will the forms be in English or Malay? (I live in JB and went there to register my car with the car salesman and i have to admit it was crazy and I had no idea what was going on!). Also, how do I make sure I get the money from the person I am selling the car to? Should I be dealing directly with the bank my loan is with and should I be looking to pay this loan off first to avoid anyconfusion?
    Appreciate your feedback on this.

      As an expat, I really do understand your predicament. From info given, you appear in a hurry to leave the country. This might create some unwarranted problems.

      Some advice that can be given to you include:
      i) Do not part with your vehicle until cash money is received by you from the buyer.
      ii) Ideally, refrain from using cheques for your transaction.Remember, cheques are liable to bounce.
      iii) Most JPJ forms / documents are mostly in Bahasa Malaysia. Get a good friend to assist you if necessary.
      iv) Dealing with banks is a good idea. They are more reliable and cab be held accountable if anything goes wrong.

      Having concluded your agreement with any party, you should ideally draw up a simple contract, to be signed by both parties. Ask somebody who has knowledge about legal aspects to draft out the above contract. Have it legally signed, preferably. Anyway, it costs approximately RM10 for the stamping at the nearest stamp office.

    If a person death and left his car that haven’t finish the loan, can the sibling help it to pay? Or need to transfer the car owner to the sibling name? If yes how, in malaysia law requirement? How about the road tax & insurance??

    Second question is if the deceased’s have more than one car and the car loan have being settle since many year isn’t need to transfer the name next of kin’s too? How about the road tax & insurance??

      For the time being, the current loan can still be continued. Road tax / insurance can still be obtained too. If JPJ advises otherwise, then you’ll have to take alternative steps.

    I’ve sold my car to a car workshop that introduced by a friend 6 months ago. This is because my car cannot pass PUSPAKOM test and need to change engine. He told me that he can settle everything including the transfer of ownership. But recently, i try to contact him to ask about the status of transfer, but he refuse to give me any conclusion and also not picking up my call. I only have a simple receipt stated the selling price.

    I’m a quite worried cause dont know where the car is. Please advise what can i do now.

      You have no choice but make a police report immediately. Should the car meet with an accident or involved in criminal activities, you will be held responsible.

    I bough 92 iswara and the car already transfred to my name.. Then i go to the insurance company to buy insurance and roadtax but the agent said i need another puspakom inspectation since the car roadtax already dead 1year ago.. What do you think??
    i already done the puspakom test for transfer ownership (4 test :engine no,chasis no,tinted,halfcut check)

      The Puspakom’s inspection certificate as fas as I’m aware last for about 1 month only. A car’s road tax that has expired for more than a year will have to undergo a further inspection again.

    I am currently in Penang and I’m trying to buy a car in KL. I am planning to get my mother to do the title transfer in JPJ KL without the seller’s and my presence. Is this doable? Can you also advise of the documents below are sufficient?

    I will be preparing there documents for my mother:
    1) TM-AB form for myself and also for the seller (does seller need TM-AB verification as well?)
    2) PUSPAKOM certificate arranged to be done in KL
    3) 2 copies of JPJK3 form signed by both buyer (me) and seller (does this form need to be verified by a commissioner of oath?)
    4) Letter from my finance company
    5) TM-1 for signed by my mother
    6) Car insurance under my name for this particular car
    7) Garan with finance release letter from Seller.
    8) Two copies of ICs, both seller and myself.

      Inspection and transfer of your new vehicle can be done by your mum. Ideally, get a good runner to assist. For JPJ K3A, the new owner’s particulars have to be authenticated either by JPJ officer or a Commissioner Of Oaths. Form TM-AB requires the identity card of buyer to be certified by the above persons mentioned. After getting Puspakom certificate (B5), then only purchase the vehicle insurance in your name to facilitate vehicle transfer. All other documents you listed out are in order.

    The loan was already settled.

    Need your advise on this. I have traded in my old car which is still under loan and bought a new car. The trade wasn’t the usual trade as the dealer unable to provide me high trade in value so he took my car to a dealer for sale.
    The dealer didnt constantly pay the loan installment and so i decided to take back the car.
    The dealer agreed with a price which is ok with me. Can you please advise me that to avoid further problems what are things i should take note of to get back the car? I have signed all the JPJ documents previously.

      When taking back your vehicle from the dealer, ideally get back the following documents:

      i) All documents you signed for the transfer purpose.
      ii) Your photostat ic.
      iii) Your vehicle Registration Card.
      iv) Get back any cover note for your vehicle which may have been purchased erlier.

      Nonetheless, you may have some difficulties on some of the above especially no. iv.

    Good article. I have an interesting situation. I have two cars which I want to transfer into my name.

    Both car’s road tax and insurance have already expired.

    Car A is in my sister’s name. I want I to transfer this car into my name, renew the road tax and insurance. I assume I will need to fill out all the forms you have mentioned, get the inspection, then complete the transfer and I can purchase the road tax and insurance after the transfer is complete? Or do I need to purchase insurance and road tax before I can complete the transfer?

    Car B is in my aunty’s name. I want to transfer this car into my name but will not be renewing the road tax or insurance (the car will not be used). Do I still need to get it inspected by Puspakom?

      For car A (your sister’s car), I feel you should renews the road tax / insurance using your sister’s name first. Then only do your Puspakom tests and buying of insurance. If you feel this is a hassle, get a good runner to help you. As for car B (aunty’s) why bother about a car you are not going to be using. So, leave it alone and do not waste your money.

        My situation is similar with the post above but in my case my father and I would like to switch ownership of the two cars we have. I understand that we first need to get the cars inspected by PUSPAKOM and then fill up all the JPJ forms, but I am not clear with the part of renewing the insurance and roadtax. We live in different places and I am planning to go to where my father is to get the inspection done for both cars and then do the JPJ paperwork as well. i would appreciate your advise on how I can get the whole transfer done within a day or two as I will need to take leave from work to sort this out as well. Thanks. Btw the reason why we want to switch ownership is because the cars are on 1st party insurance policies and to avoid any untoward incidents where we will not be covered. Thank you.

    I’m an Expat working in Malaysia. I want to sell of my car to a direct buyer. My car is currently under bank loan. I can pay back all remaining loan. What will be your advice on;

    1) to pay back all the loan, transfer the ownership to my name, then sell and transfer the ownership of my car to the direct buyer after receiving the full cash
    or
    2) Deal with the bank, receive the extra balance after settling the reamining laon,then transfer the ownership once the buyer’s loan is approved by the bank

    The other request is- Is there any reliable middle man/ service agent to whom you would like to recommend ?

      Although your car is currently under loan with a bank, the ownership of the vehicle should still be registered under your name. The bank has ownership claim over your vehicle. I suggest you talk to the bank people about your dilemma. Therefore, the attempt to transfer your vehicle to your name in fact does not arise.

    Hi please help me, Im buying a waja cash, dealer said no loan but next day admitted to having loan when asked again, so went to bank to check for loan amount.

    I dunno what’s the real story for the vehicle even tho it’s very nice. It’s been traded in and there’s issuance of settlement letter from bank means it’s been repossessed by bank, im only interested to buy it.

    Unfortunately wisma nusantara was close so best thing was to ask a banker, and check online and before i found this website i told the dealer to
    1. transfer name
    2. I pay the bank settlement myself

    but dealer
    1. showed jpj inspection letter
    2. showed resettlement letter and gave me copy
    3. said he’s “waiting” for the money which i have just to proceed with everything
    4. for some reason make everything urgent, and want me to only pay to him the money and not to the bank straight

    so postponed until tomorrow Monday and found ur website

    I want to ask u after seeing all of the forms above you mentioned;
    what is the right way to buy a second hand car in cash?

    From what i understand from the above
    0. obtain all forms
    1. transfer name or inspection whichever comes first
    2. apply insurance under name
    3. pay rest of the amount (this could be in no.3 as well) and obtain grant
    4. get keys and car

    I might as well let everyone know now so people won’t make the same mistake:

    1. I paid 1000 deposit bcos before surveying and making research i was very naive and believed the dealer when he said transfer name cost 400, puspakom cost 400 and the rest.. for i dunno… i was going to pay 500 but yeah i was stupid

    now as i realize that the dealer might want to fool me again tomorrow i better cancel the deal and hopefully get my deposit back, im not hoping for full but perhaps even 800 makes me happy cos it’s a lot of money.

    I think , i speculate, what he wants to do is to get my money in cash and not service the loan from the settlement loan, wants me to be shocked and found there’s still loan under my name, and the matter goes on and on, literally have to call him everyday to “beg” him to pay the loan until one day he will disappear on me

    fool me once shame on u, fool me twice shame on me…

      Hopefully all the documents pertaining to previous owner are in order. The amount for transfer / insurance etc quoted by the middlemen appear reasonable. What’s troubling is leaving your car for 1 day to the agent.

    Currently i have paid a RM500 booking fee for a WAJA, and my loan have approved.
    The loan and Insurance i apply my own. Because i have relative who work in that position.

    My question is :

    I would like to know what is the exact fee for Ownership transfer,Puspakom+Stamp duty?
    Ownership transfer,Puspakom inspection,Stamp duty & road tax. “Runner charge how much?”
    I do the calculation after i decide to walk into the used car dealer.

    My calculation is less than RM300 for the processing if do it by own.
    Ownership transfer : RM100
    Puspakom : RM90

    The used car dealer was asking me to paid the service @ RM1700 for the runner service.
    Ownership transfer,Puspakon inspection,Stamp duty & road tax.

    Actually i can do it myself but i was thinking to give some commission for the service
    since the loan and insurance i apply myself. just for win win situation.

    After the discussion with the dealer and RM1700 are non negotiable.
    i was thinking i can do my own to save the commission since the offer is ridiculous.
    and they are not allowing me to do my own. I felt like i have lost the consumer power
    and i’ve sacrified time, money and energy for this case.

    We didn’t discuss earlier regarding the procedure service. because i have to wait for the loan side.
    And we a good conversation at the beginning. As i survey the market they charge for RM450 to RM750
    for the service i need. To me this is reasonable to pay according the market rate.

    Unexpected they want me to pay RM1700 for the service non negotiable, fee not included insurance.
    Only ownership transfer,Puspakon inspection+Stamp duty & road tax. i know at least a clean RM1300 is
    going to the company and not including the sales profit.

    I’m not happy that the outcome and would like to cancel the car.
    The deposit burn. What should i do now? This is not a good situation for me as a buyer.

    Should i lodge a police report or complaint to NCCC? Or i just burn the deposit.

    Pls advice, as it is urgent need…

      A business contract is between client (yourself) and the used car dealer. If you are not agreeable to the amount asked, you are free to reject it. Choice is yours. Should you feel you are capable of doing the transfer / inspection yourself, by all means, do it yourself. Alternatively, you can cancel the booking made. But remember, you stand to lose deposit you’ve paid.

    Well i’m thinking lodge a report with NCCC. Actually i’m capable to do all the process myself. RM1700 at least i can save up to 70%. The dealer are given alots of lame excuses. because they want the absorb the commission.

    I found this article very helpful, I have purchased a 2nd hand car 3 years ago, and the gear box of the car was damaged (Automatic gear box) , then I have changed it into manual gearbox , and it’s still written in the red card that the car is auto,and I’m selling the car on these two days . Will this issue effect the puspakom inspection ? is it a problem ? Thank you very much for your time.

      It is of my opinion you’ll have problem with Puspakom when the car is sent for inspection. You’ll have to look for a way out to overcome this problem.

          My observations tell me you’re facing 2 problems. One, for converting into manual gear system, your car has to be inspected by Puspakom. Then, send in your Registration Card to be rectified. Two, if you sell your car, you’ll have to send your car for a 2nd inspection before transfer of names can be done.

    Bought a new car 2 years ago and trade in the old car. Sign the necessary transfer form you mentioned in the article and gave it to the salesman. Also got an acknowledgment of receipt letter from the car dealer for my trade in car, car keys and car registration card. The trade in car reg no also appears in the sales invoice as a trade in car. Should this suffice as I was not aware of the additional procedures (Inform JPJ, Police report, insurance co, stamping etc) you mentioned in your article.

    Is it too late to carry out the additional procedure you mentioned in your article?

    How do I check if the trade in car has been resold and transfered?

    Note: The additional procedure you mentioned in the article as follows:

    They should in fact:
    i) Inform in a letter to the Registrar of Motor Inland Vehicles (R.M.I.V) of the sale
    ii) Inform the Police authorities of the sale too.
    iii) Inform the insurance company of the sale as well.
    Ideally, a simple agreement should then be concluded between you and the purchaser of your car.
    In it, state that as from henceforth, you are no longer liable for:
    i) Any traffic offences that might be caused by the said vehicle.
    ii) For any accident which might involve the vehicle which is registered under your name.
    The simple piece of paper, which represents an agreement, should ideally also be stamped at the Stamp Office in your town nearby. The total cost does not involve more than RM10.

      Most people only do what you did, that is hand over registration card, IC and transfer forms. I recommend that you inform the police, JPJ, insurance company and draw up as simple agreement and stamp it.

      The later part of what was suggested maybe a little bit of a hassle. But come to think of it, it tends to benefit you more than anything else. Think about it carefully and implement it if you possibly can.

    I am in Malaysia on a work visa. I hold International Driving License and I have been driving here for over 1 1/2 years. My friend here arranged for buying a car for me, for which I paid all the money. At that time, I had still not got my work visa, so he said he had to have the car registered in his name. I had already got my employment letter by then, but visa yet to be stamped by Consulate.
    1. Now I want to transfer it to my name, and I also need to renew tax and insurance which have expired this month.
    2. Can I get the B5 without tax/insurance because I will have to pay for tax/insurance on my friend’s name? If I pay tax/insurance in his name, will it automatically be transferred to me, once the ownership transfer is done?
    3. Btw, I am registered as the 2nd driver in the initial insurance papers filed during car registration. Will that help my case?

      To transfer vehicle to your name, first of all I think you have to possess a work visa. To facilitate the car road tax and insurance, but it in your friend’s name first. Once you get B5 certificate, then take steps to transfer the insurance to your name and also do transfer of ownership. It’s all a bit confusing, Nonetheless, it is hope you’ll be able to understand my explanation. Being 2nd named driver in your insurance cannot assist you in any way.

    Cikgu yap, need advice.. I’m bout to meetup a sales person who is going to evaluate my car and potentially already has a buyer as he informed.

    I have check my car full loan settlement rm93k and roughly my car market price with all the additional modification about rm125k.

    My concern is,I’m still owning the bank but if say I manage to market/sell the car, I would have extra of +-30k in hands prior to the loan settlement.

    Need ur kind advice,when did I should get the cash or the safe way on proceeding this.I do not want to be corn by the sales people later, car is sold but the differences is gone.

      From my experience, a car when you sell it at a second hand market usually does not go up in value. If you are selling to a used car company, he will buy the car at below market value because he would have to cover administration cost, credit line cost and not to mention the risk if he can’t sell off the car.

      If you a lucky enough to be able to sell your car at RM30k profit, ask the use car company to settle your outstanding loan with the bank and then issue the difference in a cheque to you.

      This is my opinion only, the saleman may have a better approach. All the best!

    Hiya,
    I used to own an old beatle (1970’s make) which I’ve recently just sold. I have had the car for 5 years, which was initially bought and handled by my mates. I had no troubles transferring the ownership under my name back then.

    Flash back to a few weeks ago. The car was sold verbally and there was a middle person in charge of handling the transfers/checkup of the car.

    There were complications in the Puspakom check, whereby it was checked that there were discrepancies to the chassis. All this year, the car has been sent to a private mechanic, and the past two years, we have had send the car into Puspakom for insurance/yearly checks.

    It leaves us at a lurch at the moment as we cannot get in contact with the previous owner to retrieve the change of engine details. (even if we could, chances is the he has his own mechanic to change the engines and no paperworks were filed).

    What’s your take on this?

      Since your Beetle has developed problems with regards to transfer, you have no alternative but to get the original documents which your vehicle was said to have undergone. Failing which, you just cannot do any transfer at all.

    Is this correct to do. No loans on the car and he is bringing a bank check for the purchase price.

      In my opinion, the standard contract between the car dealer and his client does not protect you as the owner of the vehicle. There is no guarantee that the above contract will be honoured by both the parties. If that happens, who will then be the victim? You!

      The correct way is for the car dealer to ensure that the vehicle you sell to him undergoes the proper Puspakom inspection, followed by the transfer of ownership be done properly.

    STAMPING OF OTHER DOCUMENT E.G. COVER LETTER (alternative to the said agreement)
    I have got an acknowledgment letter (JPJ reg card, keys, car etc) from the showroom where I bought and traded in the new car. The original invoice for the new car by the car manufacturer also shows the car regustration of the old car traded in car.
    Question: Since its already 2 years, is it too late to get the stamping office to stamp the cover letter that was acknowledge by the car showroom (if this can be an alternative stamping document to the “agreement”?

    INSURANCE FOR OLD TRADED IN CAR – NOTIFICATION
    I have already canceled my car policy 2 years ago when the old car was traded in and transfered the NCB to new car. Would’nt this be sufficient as notifcation that the old car is no longer my responsibility from the insurance stand point?

    If still need to inform the insurance company, its already 2 years, is it too late to do so?

    HOW TO CHECK WHETHER OLD TRADED IN CAR HAS CHANGE NAMES?
    Where do I go at JPJ to check whether my old traded in car has change name? Is this allowed?

      Even though the official Road Transport Department’s transfer form has been transacted, my personal experience tells me that writing to inform the insurance company, the police and even the RTD is never a lost. Many people in fact do not keep a record of the above.. Copies of the above, if kept properly in a file goes a long way to assist one later on.

      In the 1970’s, after selling off my vehicle to a finance company, I still received a solicitor’s letter instituting legal proceedings against me, I was lucky to still have copies of my letters to the authorities in my file. Upon advising the solicitors concerned that I was no longer legal owner of the vehicle, resulted in my not hearing from the solicitors anymore.

      Regarding stamping of your agreement, since 2 years have elapsed, it is my opinion that it is no longer appropriate for stamping anymore. The same applies to the insurance company too.

      With regards to checking whether traded in cars have undergone transfer of names or otherwise, the JPJ are strict and it is my opinion, they do not entertain any individual requests unless it is done legally, that is through your lawyers.

    Hi, i sold my car to the car dealer 2 years ago at Kuching before i back to Klang. But i received 2 saman from PDRM for parking Jan’12 this years. Then only i found that the car still under my name.

    I have sign all the transfer form before i come back. the car dealer just bank in the money straight to my account when im back with no receipt.

    I have call the car dealer, but they refuse to do anything. Just give me the new car owner phon number and ask me to call him myself. I have call for few months, the new car owner 1t said the document i sign is lost. Then said the car already change engine n JPJ not approve. Recently said later later….

    But the saman keep coming…even i already do a report at Police station and go to JPJ. They didnt do anythings.

    I wonder….can i just go JPJ to report the car as engine damage?

      If the dealer charges RM90 for B1 and B5 tests, then it’s reasonable. RM40 is the Puspakom charges only. Dealers have to charge you service fees. With regards to outstanding bank loan, it’s up to you whether you are able to accept it or not.

    “The Seller(Previous Owner) will make good to Buyer any damage that Buyer may sustain through any defect and dispute in Seller title and the Seller further under to refund all monies and any subsequent expenses incurred there on in case of any cancellation of license by register and inspector of motor vechicles of the said vehicles.”

    Is it safe to proceed the sales with him?

      In PJP TM-AB, the new owner’s identity of the vehicle must be attested by a JPJ office of a Commissioner of Oath. JPJ K3 Pt. 1 to be signed by former owner. Pt. II to be signed by the new owner.

      It’s up to you whether you wish to abide with the agent’s request or otherwise.

    The car dealer said I need to go JPJ to do the ‘Penyaksian Pengesahan identiti pemunya berdaftar’.
    Can I do this in any JPJ in klang valley without the car dealer presence? Or both me and the car dealer must be presence?

    He also give me an option to let runner settle the ‘Penyaksian Pengesahan identiti pemunya berdaftar’ on behalf of me for a fee of RM150. I was wondering if this is ok?

      Confirmation of seller and buyer’s MyKad has to be done by either a JPJ officer or a commissioner of oath. Using a runner service might incur risks. Be careful.

      Procedure of transfer differ slightly. Regarding, I can only assist you if you are in Klang area. If possible, settle your hire purchase to get back registration card and letter of discharge. Above will facilitate your selling of your car later on.

    Having a bit of a problem, I was an international student in Malaysia but had to move to Canada suddenly because of immigration. I own a proton satria that I am in the process of selling but since I am not in Malaysia physically the transaction is being handled by a friend of mine.

    How can I get the transfer of ownership to work out in my scenario since I wont be in Malaysia myself?

    However, i encountered some problems in dealing with the bank. I am currently in overseas, and my mom is helping me selling the car to one of the car dealer, back in Terengganu. She is the guarantor for d loan back then (Maybank Kajang). I believe all documentation w/ RTD solved, but the bank is not allowed anyone else except the owner to transfer the authorities (or something). So, how can I make it done? My mom is kinda old, and not really knows this kinda stuff, while the dealer is sucks big time. Please please help me on this. Thank you very much in advance.

      I suggest your mother meet with the bank to make full settlement of your loan. In this manner, your family will be able to get hold of your vehicle documents and release letter, thereby enabling your mum to proceed with transfer transactions with JPJ.

    Hi Cikgu

    I’m selling my car to a company. Actually we’re half way through the process already. The company hired a runner but progress has been slow. I’m migrating in a few days time so I’m trying to rush through the transfer. The company has got the loan before Puspakom inspection. The bank is asking for the inspection report and waiting for the company’s downpayment and necessary documents before they can release the money to me.

    My questions:

    1) Are the procedures any different from selling to an individual?
    2) Who should be handling the Puspakom inspection – the seller or the buyer?
    3) I read that the seller must be present at JPJ to do the transfer. What if things got delayed and I’ve left Malaysia? Can I authorize my father to sign on my behalf should there be other paperwork to settle?
    4) When should I release my car to the buyer – once the transfer is done or after I get my money?
    5) When should I terminate my insurance?

      Selling vehicle to individual or company is the same. Bank will give you loan only after Puspakom inspection done and registration documents are in their hands. Puspakom inspection can be done by either party (the seller or buyer). No, your father can’t isign on your behalf. I suggest you sign all the necessary documents before going overseas. Seller not necessary to be present for transfer purposes. Insurance can be terminated once Puspakom inspection is finalised and transfer can be transacted.

    I am going to trade in my old car. As I know some agent would not transfer my old car to their company name until they find someone to buy my old car. In this case, besides S&P, anything i can do to prevent bad thing happen in the future?

      Most car agents do not bother to transfer cars sold to them. Sales agreement are of little use. It may help you to a certain degree though.

    Cikgu Yap, if i want to transfer a vehicle where the registered name is already deceased, do i leave the signature of the current owner in the JPJ K3A form blank or someone needs to sign? Im buying a car from someone, but the car is still under his deceased mother’s name. Since im not a family member, will there be any complications.

    Maybe you can explain the steps in filling the JPJ K3A form completely in case of transferring from a deceased owner.

      You’ll need a death certificate to assist in your transfer. Transferring a car in your circumstances will always be a hassle.

    I found out there are issues involved it especially on the hire purchase loan, as all the while I am paying the loan, insurance, and road tax

      You will have to draw up a new contract for your loan. This will cost quite a lot of money. You will have to send your car for Puspakom test. Fee charged by middlemen can come to some RM400-RM500.

      In buying new insurance under your name, you’ll have no NCB, thus insurance will be very expensive. Think carefully. Is it worthwhile changing the car to your name? Best alternative is use your sister’s name for the time being.

    (1) I planning to sell my car to my friend whom has a car. Currently I still have outstanding loan , and he will sell his car to 2nd car dealer. So, what should I do first? And, for his part will be dealing with the car dealer and get loan from bank to pay off my outstanding loan. Subsequently only I will get the original car registration card from bank?

    (2) I have read though the previous blogs where I need to get the transfer form (TM 3, TM-AB and JPJK 3) and send my car to Puspakom for car inspection (Will get form K5 and pass to JPJ). Who should be the one paying all the charges? Seller or buyer?

    (3) the new insurance. The buyer will have to purchase a new car insurance ONCE the car title transferred under his name?

      Ideally, your friend should first settle his loan. Then talk about buying your car. Charges ideally borne by buyer. After Puspakom inspection done, new insurance to be bought under new owner’s name.

    I have face some difficulties of transferring the ownership. 1st of all, the owner of the car need to clear all the saman he had. We went to the police station and pay the saman den we went to the jpj. And the jpj ppl told me, that the owner need to go to the court becoz of , the road taxs and insurance of the car had dead.( i not really clear what he mean too) The point is, if the owner din go to the court, i will never can xfer the ownership to me. So now even he had paid the saman, and also renew the road tax. I still cannot transfer ownership to me.

      Transferring ownership as I’ve said, is always a big hassle. It’s not only pay up all the outstanding summons that counts. Court cases which have not been attended will have to be settled too. As such transfer of ownership still cannot be done yet. The seller and you must both see the Road Transport Department about it.

      Correct, after Puspakom inspection of a 2nd hand car, purchase insurance in your name and then submit all relevant documents to JPJ. Your old vehicle number plate is interchangeable with your new vehicle. You will have to meet the Road Transport Department officials for advice regarding the above procedure. When all the requirements you need is eventually met, then only can you proceed with the bank loan.

      Only if the car is registered under your name can you make transfers. Should the vehicle be under your company’s name, you’ll need a covering letter advising transfer to you. Alternatively, if the car is still under loan, you will also require a release letter from banker or finance company.

          Ideally, a company letter head be used. It should be signed by someone of authority and official chopped. The letter of advice to JPJ should briefly read, “Our Company possess no objection of (your name) and IC No. being transferred ownership of the said vehicle.”

    Dear Cikgu Yap,

    Thank you for an excellent article and it’s amazing it is still “alive” after all these years. I am in a predicament and your opinion would be most welcome:

    1. In May 2005 my wife sold her Kancil to a person.
    2. She and the buyer signed all necessary documents – JPJ K3, Letter of Indemnity. We execute a simple S&P but unfortunately forgot to stamp it.
    3. Until August 2005 we still get letters from the bank for late payment. After facing the new owner, urging them to settle the loan and then transfer the name, we believe the loan was settled.
    4. Upon checking with the bank (HL Finance at that time) it was indeed settle. We would thought the buyer changed the ownership to his name.
    5. Sometimes in December 2005, we received some summons, so again we faced the buyer to change the name.
    6. Also at this time we made a police report on the situation to protect ourselves against future summons or any possible criminal act committed using the car.
    7. After the buyer assured the name has been changed and we no longer received any letters nor summonses, we thought all was done.
    8. Today, after 8 years! , we received a demand letter from MBPJ on unpaid parking ticket!
    9. I decided to go to JPJ website where we can check the road tax expiry date and lo & behold!, using my wife IC no. and the car reg no. shown that the road tax just been renewed in May 2013. So we believe the car name was never change.

    So here’s the questions:

    a. What is our avenue to resolve this? Can we go to JPJ and unilaterally change the ownership using the old K3 form? I still have the buyer Attested IC copies. Or can cancel ownership? Or black list the car?

    b. Should we make another police report? We still have all the documents (i requested they signed an extra copies just in case). What is our legal avenue?

    b. The issue is we don’t know where the car is or where the “buyer” is.

    Appreciate your kind opinion on possible action.

      Before I proceed to answer your predicament, allow me to tell you a little secret. Sitting under a rambutan tree in the compounds of our house is my son’s Kancil which he gave up using about 4 years ago. Inspite of many buyers wishing to purchase it, I’ve refrained from disposing of it. Do you know why? You see En Abdul, I don’t want what happened to my close buddy, Mr Ong, whose jalopy he sold 18 years ago continued to remain in his name causing him immense problems.

      Likewise, your wife’s Kancil sold in 2005, up til today is still in her name! In short, I do not want such a thing befalling me.

      Coming to your present predicament, what can you do about it? You various suggestions put forward by you, such as unilaterally changing the ownership using old K3 form and ICs in your possession, cancelling ownership, black listing your wife’s car, all not feasible. For example, to change ownership will result in you committing fraud, don’t forget that.

      Furthermore you yourself said that you do not know where the car or the owner is presently. Legally, in my opinion, there’s not much you or the JPJ can do about your on-going problem.

      You have no choice but to bear with your problem for some time yet, until the buyer decides to make a transfer of the said vehicle.

      However, the suggestion to make a new Police report against future summons and criminal acts which might be caused by your wife’s Kancil is good. Hope all the opinions I have given you will go on to lighten the burden you’re presently facing.

    Hi Cikgu Yap,
    I recently bought a car form 2nd hand dealer. I received the car 2 weeks ago with new insurance with me name, there is puspakom inspection result, etc. However, until now the geran not yet transfer to my name yet.
    I checked with bank loan personel, bank has not released the loan to car dealer. Also went to JPJ confirm road current tax still active till year end. And JPJ officer also informed me that there is a record showed that previous owner loan just fully settle, etc …

    Questions:
    1) Do I also require to renew my road tax prior bank transfer the geran ownership? I heard there is new rule starting July 1st, 2013 from JPJ that require road tax renew pior hakmilik transfer.
    2) Puspakom is 30 days expiry?

      In normal circumstances, the car dealer will not transfer the car to you as your bank loan has yet to be finalised. Road tax matters leave it to the agent to settle.

          Doesn’t matter who does the transfer. Allow the bank to transfer quickly. Your Puspakom inspection only last 1 month. Yes, you’ll need to renew road tax later.

    My bro in law passed away after recently bought an expensive car. My sister can’t afford to pay the monthly installment. My brother is willing to buy it from her but only by way of continuing the installment ( which is under the deceased name).

      Your brother taking over you sister’s vehicle is a good suggestion. In a way, it prevents the bank repossessing the car. Continue payment as usual. Later on, your brother can find alternative ways to transfer the vehicle.

    Recently, i have transferred my car to my brother via the MYEG Voluntary Private Vehiche Ownership Transfer as he’s not in KL to perform the necessary transaction and the car loan has been settled.

    When he tried to renew the insurance, the post office said the vehicle is having conflicting name for owner on the car registration card.

    I like to check, after we have perform successfully the Voluntary Private Vehiche Ownership Transfer, isn’t the car under the new owner’s name and he could buy the insurance under his name?

    Secondly, do we still need to/able to(and what is the procedure) to renew the name on the car registration card?

      I am not aware that a vehicle can be transferred other than through Puspakom inspection only. Most likely, the vehicle is still under old owners name. Make a check with JPJ immediately.

    NO proper transfer to ownership Even to Distributor as trade in?
    Currently I hv paid deposit and trade -in my old car in exchange when new car arrive from car distributor(not 2nd had car dealer). I said transfer of name need to follow proper procedure. Now the sales man said my old car is schedule for Puspakom early next week and my new loan approved -I can get my new car end of Next week. For transfer of ownership form given is only JPJ K3 -2 copies and 1 copy of TM-AB-and I need to go JPJ to get them certified. However he said once the new car arrived and I left my old car to them -they will get it to JPJ to cancel it and I can get my insurance NCB refund. However, the distributor(sales person) said they will not signed on the transfer of ownership till they find new buyer.
    It look like we once paid deposit- we are at the mercy of the car distributor (as Transfer of car ownership not done when old car given to them? The only thing they can provide -is Bill of Sales- which I need to sign to said my car is in proper condition & a copy of JPJ cancellation of my car grant -few days later after accepting the new car.

    How any advice from Cikgu?
    Anyone else -feel free to provide your experience.

    Dear Cikgu Yap,

    I have surrender my car to bank and car was auctioned by Maybank in 2012.
    Last year 2013 I received summons for this car and I immediately called the bank for clarification. The officer said we unable to contact the new buyer via phone (his number not active). Bank has been sent reminder letters to this new buyer but he did not respond to bank for ownership transfer. But they promised they keep trying to contact the new owner and will change ownership as soon as possible. Finally bank officer managed to settle the summon with JPJ.

    This year 2014 once again I received a summon for the same car. I called them and email to customer service I did not get a response or a positive feedback from them. I really have no idea how to settle this problem? Is it sensible, Bank can release the car to new purchaser without transfer ownership?
    I can’t imagine how my name would be affected if the new buyer is involved in any illegal smuggling or bang someone with these cars.

    Kindly assist me what I should do now?

    Hi Cikgu Yap,
    I’m in the midst of selling my car to a private buyer. Will require your advise on the steps from here.

    I’ve settled the remaining balance of my loan with my own bank and the buyer has paid me a deposit of 2K.

    1. Now I’m pending the collection of the Hak Milik Batal which is to be issued by the bank.
    2. From here, I was advised by the bank officers that once I obtained the Hak Milik Batal, I would need to go to JPJ to transfer the title of the car to my name? Is this correct or can I skip this step and upon the sale of this car, transfer it direct to the buyer’s name?
    3. Assuming I did step 2, the steps are not clear from here.
    4. I was told that I need to get the E Hak Milik letter from my buyer’s financier – is this referring to the letter of undertaking?
    5. Then with that document, I would go to Puspakom to inspect my car and from the check, I would obtain the test report? Is this right?
    6. Once this is done, I will go with the buyer to JPJ to initiate the transfer of ownership with all the necessary documents.

    Can you let me know if the steps are in order – furthermore, in all these transaction, when do I actually get the buyer’s financier to release the money to me.

    It feels like I’m missing a step here and unclear on what is the correct procedure.

    Would appreciate your advise.

    He have ordered a new vehicle and wants to retain his old number.
    Hence i will get a new number.

    I have a Viva registered under personal name. My company (sdn bhd) wants to buy over this car. So I need to transfer a personal car to become company car.

    I just went to JPJ this morning to ask for the procedure. I was told that the owner of the personal car and a wakil from the company have to be presented in JPJ to carry out the process. That really chickens me out, because no one from us has the time to do that.

    I am willing to pay the runner to do this. But can the runner can help me in this case? What process (authorization letter?) or documents needed to get the runner to help me?

    Dear Cikgu Yap,
    I should have found your website before selling my car. Now, I have lots of sleepless nights.

    It started 4 months ago when I agree to sell my car to a car salesman. Agreement has been signed and a police report has been made. The report says that the settlement will be completed once the new buyer pays for it and in the meanwhile, all payments due is to be settled by the salesperson. Sounds OK to me.

    However, 4 months later, the salesman have not sold the car nor settle the balance loan. He have paid 3 months of installment and is missing the 4th month. Also, the insurance top up, which is caused by removal of NCD remains unpaid back to me. Now, car in under my name, loan remains unsettled and there is already 4 samans on my name with this car. I tried calling the person and text him but he just refuse to answer my text and calls. So, I text him to return the car and I will refund him his payment on installment or I will go to the police to report the car as missing. He text back and said that he bought the car and according to the agreement, he has done nothing against it. Therefore, he is not breaking any of the agreements. He then challenge me to take him to court on this matter if I am not happy about it because he said he is not at the wrong.

    Now, he again refuse to answer my calls or pay for the car. I truly need your advice on this, or do I need a lawyer now? Please help.

    I have recently sold my car to the used car dealer. By the time selling my car to them they straight away call up bank to check my car outstanding loan amount and pay me back the balance after the loan settled and early settlement refund.
    But I found out the used car dealer paid me slightly less then the settlement letter stated, I did call them up but they refused to pay me back.
    Is that a way I can still get it back in a source of legal way? But that is not a big amount.

    My brother-in-law from Langkawi passed away recently. He was unmarried and had no children. His brothers and sisters have agreed that my wife, the eldest in the family, should take possession of his car. It is being looked after by a mutual friend in Langkawi, where it was purchased in 2009, until it can be collected. It is fully paid for. My wife has the registration document and a copy of the death certificate, but she does not know what she needs to do next in order to obtain ownership of the car and then to be permitted to take it off Langkawi and bring it to KL.

    Hi Cikgu Yap,

    Thank you so much for sharing your wisdom here, it’s really appreciated.

    I’m an expat foreigner in Malaysia, looking to buy a used car … I’ve found one that I’d like to buy and it turns our that the seller is also another expat foreigner in Malaysia. So I feel we are like the blind leading the blind trying to navigate this process!

    The latest info I can find is that the seller needs to take his car to PUSPAKOM for a “transfer of ownership” inspection (B5) … after which he’ll get the K5 certificate.

    The car is parked privately off road and is currently not taxed (or insured?), so he will need to re-tax/re-insure the car before he can go to the closest PUSPAKOM.

    He’ll then have to go to the JPJ and cancel the tax and claim a refund (pretty much the full amount given that it will be a brand new tax disc) … and then to his insurers and cancel the insurance (and again claim a refund on the balance).

    Is this all correct so far?

    Meanwhile, I’ll need to get an owner transfer form (JPJK3), and inspection form – Borang Semak TM3 (or is it TM-1?) and a new ownership certification form (TM-AB) from the JPJ and fill all these out (together with the seller?) … and all these forms are in Bahasa Malayu I suspect, so I’ll need to enlist the help of my Malay friends and colleagues.

    I also need to take out my own insurance for the car.

    Finally, together with the seller we have to take all the documents together with the K5 form from the PUSPAKOM inspection, and my new insurance note, plus our passports (and passport copies) to the nearest JPJ where we submit the application for transfer of ownership (which may take 1-3 days to process).

    Ok, thats what I currently understand. Have I missed anything? Have I made any mistake? And most importantly, given how complicated it is, especially being a foreigner, how much of the process can either the buyer (myself) or the seller have handled by a “runner”. I would suggest the cost would be very much worth it if some of the pain could be taken out of this process.

    At the moment I’m thinking I might just look for a different car instead, one thats being sold by a dealer rather than a private seller, just because they are better placed to handle the purchase/transfer.

    1) Can I authorize my family member to take care this matter for me? Do I have to get them the power of attorney letter or sort of authorization letter?

    2) I have a cash buyer who offer to buy my car. What is the best solution to sell the car safely? I still have outstanding with my auto loan financing though. How am I proceed with selling off this car? Do I have to clear the outstanding balance first and get the paper work done in the bank with the present of buyer or the buyer can directly pay to the bank with my authorize person present?

      Your present number you dislike should be transferred to another vehicle (say a motorcycle). The new number of the motor can therefore be used for your old previous vehicle. All in all, it’s quite a difficult process!

      Avoid handing car to dealer. Get full payment first. Then ensure transfer is done properly! On your part, get the money to fully settle your carloan. Don’t be too over ambitious!

    I’ve read your articale above however i don’t understand this part.

    They should in fact:
    i) Inform in a letter to the Registrar of Motor Inland Vehicles (R.M.I.V) of the sale
    ii) Inform the Police authorities of the sale too.
    iii) Inform the insurance company of the sale as well.

    I’m the owner of the vehicle and currently in the midst of selling the vehicle.

    My thoughts are to conduct the following steps.

    1) Contract for deposit 10% from buyer.
    3) informed my insurance company.
    2) Puspakom inspection.
    3) JPJ inspection.
    4) Sales Done.

    My question are:
    1) how do i inform the police ?
    2) RMIV is ? puspakom ? which what where is this office ?
    3) which steps am i missing ?

    Wow, I have to say its indeed a great blog and gain so much knowledge about car issue by reading it. I got one issue here. I am a expat who works here under working visa. I just bought a car a year ago and need to sell it since I am leaving the country. The problem is the car still under the loan. So one of my friend advise me selling the car to the buyer by making a police report, without ownership transfer , In the policy report states both us details( buyer and seller), the buyer will continuously pay the loan without any delay otherwise bank has the right to reprocess the car. She did the same way to sell the car, I am wondering can u do the same way? Is it legal? What documents I should get from buyer to avoid further conflict?

    I am facing some troubles in car ownership transferring matter.

    This is the problem scenario: an old car in which under my father’s name (from Penang) was sold to my friend’s relative (from Melaka) who happened to say that he is a car mechanics and had experienced in dealing with used car. My friend and I are the middle person all that while between the buyer and seller and the deal happened in KL. Now that the payment has been fully made and upon taking the car, I handed my father’s car registration card (original) to the buyer. My friend said that the buyer will help settle the rest of the paper work so my father just need to go JPJ (Penang) for thumb print to transfer the car ownership.

    My father and I thought this was a straightforward deal. However, on the day the buyer took the car and drove back to Melaka, the car broke down and was then towed to the buyer’s mechanic shop. He claimed that he will repair and do whatever fixing before sending to PUSPAKOM for inspection and then JPJ. Once everything done, they will inform my dad to do thumb print.

    But, their repairing work takes forever, and I have been chasing after my friend for updates. This has caused a dilemma situation between both parties. How and what should I do to save the situation and to protect my father’s right? Will the transferring be difficult to resolve if they keep dragging the repairing work? Hope to seek for your professional advice. Many thanks!

    Hi Cikgu Yap,

    So here’s the deal, recently my sis-in-law had bought a new car (Car X) with plate number (xxx) and switched the plate number with her old car (Car Y) plate number (yyy). Now, Car Y (with ‘xxx’ plate number) is passed on to me. Before this was done, a transfer of vehicle ownership for Car Y had been done between her father and her about two months ago. During this process, car was sent for inspection and transfer was done in Puspakom and JPJ respectively along with necessary documents.

    The problem; Both insurance and road tax have expired last month for my car (Car Y, xxx no.plate). Transfer of vehicle ownership between me and her have not been done but insurance has been purchased yesterday under my name. I now posses the set of certified transfer forms, our respective certified I.C copies, and all the documents of the transfer that was done between her father and her 2 months ago including the ones from Puspakom.

    What do I do now? Since my road tax is expired, I cant legally drive the car to Puspakom. Also, since my insurance has been purchased under my name yesterday, I can’t purchase new road tax at the same time as the car has not been officially transfered between both parties. Your advice?

    Also, do both parties need to be present during the transfer in JPJ or inspection in Puspakom? I heard that she has to be present as well to give her thumb print? Please advice, major headache at the moment.

    Hi there!

    I really hope you could help clarify a few things for me. I want to purchase a second hand car from a direct owner and I’m not planning on taking a bank loan. Firstly, the seller has yet to pay off her final loan to the bank and requests that I, pay a deposit to her in order to for her to pay off her bank. As it is not really a small amount, how do I go about without having to handle the cash and what guarantee do I need/ have after paying her the deposit? The seller claims that once she has paid off the bank, she will then head to puspakom and once I have paid the balance of the payment, only then will she transfer ownership of the car to me through JPJ. I have never done this before and I am extremely grateful for any advice.

    The company which I work for had purchased a car (KIA FORTE) 2013 under my name ( 9 years loan) coz the company had difficulty in getting loan. However, the company is paying the monthly installment. The problem is the car has been painted with company logo, etc. and I want to get a car for my personnel use.     My husband bought a car frm a so-called 2nd hand car dealer and paid had full with no outstanding amount.
    Its an imported continental car. But the car grant was not given to us , so now when we asked
    for the grant he said that we have to pay RM2,500 to release. Right now the car is with us without any legal documentation neither the road tax nor the insurance. Question: Is there such a thing that when we purchased a car whatever the year with more than 15 years, do we have to pay for the grant.

    I sold my car to 2nd hand car dealer early October and gave them my original geran.

    When I went to JPJ to cancel my road tax and ask for refund, they ask for original geran? But when I call the 2nd hand car dealer, they refuse to give me the original geran.

    Please advise what can I do to get my refund road tax since i have balance of 9 months of road tax which I bought for 273/-, I have the original road tax and copy of the geran.

    Hi cikgu Yap,

    I would like to enquire about the interest of vehicle law in Malaysia.

    10 years ago I purchased my car under my father’s name and my father passed away 8 years ago. He only left a will which refer to the transfer of property ownership to my mother but didnot mention about the car ownership.

    All these while my agent has no issue for my road tax and insurance renewal. But for this year, he unable to renew my road tax in my eg because it stated that the owner has passed away.

    I have no choice but to proceed for the ownership transfer. since the car loan was settled so I thought of collect my grant and proceed for the transfer of ownership. Something funny is, when I approach bank (used to be eon bank but eon bank was took over by hlb bank so I went to hlb), the staff told me that the grant was not in the bank and no one know about where is the grant. I contacted my agent who used to be renewed my insurance and road tax but he says he have no idea and he could not do anything.

    The bank didnot even go to search for the document and they just viewed from their system. In my opinion, they are lazy and don’t want to bother because it was 10 years back’s documentation and hlb just took over eon bank in recent years, maybe the documents went missing along the bank hand over process or maybe my agent collected the grant for renewal but forget to return to bank. (My agent told me very firmly that all this while he did the renewal from myeg and he can’t remember he took the grant. However the bank staff says 7 – 8 years back where got myeg? I found out that myeg already in service more than 8 – 9 years but it was not being highly promoted only.)

    1) I have learned that before I could proceed to any application I need to have at least the grant with me. However I don’t have it now, whom should I approach now? Bank ( to ask them show me the documentation that whom collected my grant), lodge a police report saying that my car grant is missing then show to JPJ as prove, JPJ office, land office to get a LA because my father didnot left a will for the car ownership, amanah raya ?

    2) what should I do for the car ownership transfer provided that the owner has passed away without a will for the ownership transfer.

    It’s urgent because my road tax is going to expired tomorrow and I got this news 2 days ago. Staring from tomorrow I will have no car to drive because I’m not allowed to drive a car with expired road tax.

    Kindly advise what should I do in order to transfer the car ownership to my name.

My wife will still be here so can I give her Power of Attorney to sell my car? (obviously, the car is in my name). My second question is that my car has window tinting (except the front).       You can give your wife the Power of Attorney. But to do the car ownership transfer, the car owner has to be present.

      Regarding window tinting, only going through Puspakom inspection will you know the answer.

We planned to visit his bank loan provider to transfer the loan and the right of ownership. Or should we go to the jpj first, then the police report and also insurance company.. Need to know the right sequence . The bank, the police, the jpj or the insurance company?

      Standard procedure of transfer applies. Your car may have to be sent for inspection (road tax expired 1 year already).

    cikgu Yap. i bought a new toyota vios year 2010 . i have a balance outstanding for 1 and half years which amounts to rm15,000. as my daughter is 21 got a valid licence of buying a car.. can i as mother can sell to my daughter for around rm30,000 which means the amount arond rm15,000 to settle full payment and the balance rm 15,000 by cash in hand

    Hi Cikgu Yap I am about to buy a used car from dealer. When I search this car no. plate I found there are still saman by PDRM not yet clear. JPJ saman not sure because I don’t have the previous owner IC to check. The car already transfer name from previous owner to the car dealer, got the Sijil Pemilikan as proof. My question is, if I bought the car and transfered under my name, do I have to bear the previous saman from Polis & JPJ?

      If the car is now in your name, you then do not have to bear the old owner’s summons.

    Hi, need advise.

    My dad owned a honda civic 2.0 which he bought 5 years back (9yrs loan). He passed away 2 years back. Upon his death, we obtained LA from lawyer to withdraw his savings from bank and to list down his assets for change of ownership. But we couldnt change car ownership until the total loan is settled. We only managed to settle it last mth and obtained the e-hakmilik statement from bank. What is the next procedure? Puspakom? Jpj? Pls note we managed to get 6 mths road tax twice under my dads name but they have expired now so the car has no road tax at the moment. But we still have insurance until this oct though.

    I would like to change the ownership to my mum but she has no driving license so is it possible? Can she own a car without valid license?

    Or can i change it to my bro who is 17 this year may? I was told he can obtain his driving license once he turn 17. Need clarity.

    Pls advise on the above, much appreciated.

      You already have the e-statement. Next, send your car for inspection. You can transfer the car to your mum’s name. Alternatively, your brother could get his license.

    Cikgu Yap, recently I sold my car to a foreigner, saying his wife is local can do the ownership transfer so I sold to him. At the end he never transfer the ownership to himself, the car liability still one me, but then he sold the car to another foreigner, now I don’t know where is the car, now I worry about the people who buy the car, what if they take the car to do crimes and get alot of summon? I will be in big trouble….can you advise? Thanks a lot

      That’s the problem selling a car to foreigners. You have now to bear the duty of being responsible for the car as you are still the legal owner.

    Hi Cikgu Yap,

    I’ve just agreed to sell my car to someone. May i know if the below is still applicable?

    ………………………………….

    i) Inform in a letter to the Registrar of Motor Inland Vehicles (R.M.I.V) of the sale

    ii) Inform the Police authorities of the sale too.

    iii) Inform the insurance company of the sale as well.

    Simple agreement

    Ideally, a simple agreement should then be concluded between you and the purchaser of your car.

    In it, state that as from henceforth, you are no longer liable for:

    i) Any traffic offences that might be caused by the said vehicle.

    ii) For any accident which might involve the vehicle which is registered under your name.

    The simple piece of paper, which represents an agreement, should ideally also be stamped at the Stamp Office in your town nearby.

    I’ve not done any transfer of ownership before. Appreciate your feedback

    The total cost does not involve more than RM10.

    I’m currently not in Malaysia, but i want to transfer my car to my brother, who is staying in Malaysia. My concerns are as follows:

    1) do i need to present during the car ownership transfer? (or i can just sign all the required forms and send to my brother and as a runner to do the transfer?)

    2) can i do the ownership transfer after the car insurance and road tax expired?

    3) can i do the ownership transfer after my car licence expired?

    4) where can i renew my car licence at abroad (i’m currently not in Malaysia) ?

    I look forward to receiving your reply Cikgu Yap. (I had checked JPJ website but i’m still clueless as there aren’t much information and its not as detail as yours….)

    Hi Cikgu Yap, this is a really helpful post. I would like to ask some questions. Is it the owner’s responsibility to send the car to Puspakom for inspection and to handle the transfer of ownership?

    I’m currently buying a car from a dealer and he is charging me RM 980. Some of it goes to a runner but I think it’s still too steep. What are your thoughts?

    I successfully tendered a car and paid the tender price. Car and Registration card given to me. Its had been two months and the owner is delaying the transfer. I have been chasing them on a weekly basis. Road tax due 22Feb2018. What should I do next. take legal action or to lodge polis report.

    Its really a good explanation, I am buying a can form my colleague, but I wanted to know what is the process for CAR ownership transfer between foreigners. I heard not all JPJ branches will accept to do this transfer for non Malaysians. Seems there are specific centers only can do this. Is this correct, then can I get the more info on this? I cant find any info about this online. Please help me and advise on this. I am planning to do ownership transfer on 15th Feb. Puspakam already completed.

    And car insurance should be purchased before transfer by buyer or after transfer?

What’s the difference between the buyer buying with cash or buying with a bank loan?     I SELL A MOTORCYCLE TO A FRIEND FOR RM2000.
    AFTER TRANSFER TO HIS NAME , HE JUST PAY ME RM1000.
    AFTER 2 YEARS, HE RETURN ME THE MOTORCYCLE AS PAY OFF HIS DEBT RM1000.
    HOWEVER DUE TO THE MOTOR HAVE SUMMON SO HE CAN’T SUCCESSFULLY TRANSFER BACK TO MY NAME.

    I HAVE THE MOTOR BUT NOT MY NAME. HE HAVE NO MONEY TO PAY OFF HIS SUMMON.

    HOW CAN I DO TO TRANSFER IT BACK TO MY NAME WITHOUT BEARING HIS SUMMON?

      The motor is now in your friend’s name. He has to bear the summons , not you.

    Hi Cikgu Yap.
    I was informed by my bank officer that the seller has to sign a bill of sale for the car that I am getting the loan for, in person at the bank with the bank staff as witness. The seller is a Malaysian but now working overseas. If he cannot come back to do this in the next few month, is there another alternative to getting the bill of sale signed?

      An agreement should be signed in the presence of the buyer and seller. I doubt the bank will agree to the seller being absent.

        So this means if the seller is in the US or another corner of the world, he or she has to make a trip back to Malaysia just to sign that bill of sale.

          Sorry Kim, it looks as if that’s how the “law” operate. However, try talking to the bank and see if they could agree to allow you to have a copy of “the agreement” You could then have the above sent overseas and have it signed.

      The situation whereby your father’s car has not been used for 3 or more years without R/Tax & insurance, requires the expertise of someone very experienced in matters related to J.P.J rules on “transfers”. This writer can only advise you look around conscientiously for the correct person. Whether you’ll able to find him is anybody guess.
