Saya mempunyai banyak saman melibatkan parking kereta, tetapi kesalahan tersebut dilakukan oleh orang lain (kereta nama saya).

Persoalan
Apakah saya patut dipersalahkan jika;

1. Pertuduhan ke atas saya, sedangkan kesalahan org lain melakukannya
* Saya mempunyai bukti dimana saya berada semasa kesalahan itu dilakukan.
* Apakah saya dikira bersalah sekiranya kenderaan saya digunakan utk tujuan jenayah dsbnya?

2. Notis kompaun yang dikeluarkan tanpa tanda tangan dari penerima (semestinya saya sebagai penama kenderaan tersebut tidak mengetahuinya)
* Pihak majlis tidak pernah memaklumkan kepada saya samada dengan menghantar notis tawaran kompaun secara terus atau secara pos berdaftar.

hello Mr Yap.
last few days, i along with friends went out for late dinner. when we were about to go home, i accidentally crashed somebody’s car. fyi, i drove my friend’s car and crashed that car at the driver’s door. we were too freaked out that we didn’t stop and went away looking for help just because it’s already 12 ++ am and besides we were all girls.

on the way to seek for help, we’ve been chased by a car, there were two men in the car asking us to stop, but we didn’t. terrified by the thought of that men were some sort of bad guy, we didn’t stop. until we stopped at a traffic light, one guy got out from the car, came to us and showed an ID card of a policeman.
after checking my IC and asking my phone number, he asked us to go back to the incident scene to check out that car, so we went back there.
after a negotiation with them, i decided to be responsible for the repair cost.
knowing that we were just 18 going to 19 this year, that owner of the car aka the policeman didn’t push me to pay it asap.

i told my brother about that incident, and he asked me back, how did the man parked his car? turned out i realized he didn’t parked his car properly and not in the parking lot. my brother said, dont pay the repair cost, he is taking advantage on us just because we were young and all girls. even though i crashed his car, it was his fault who didn’t park it correctly.

so my question here, is me brother’s statement valid saying that it was that policeman’s fault who didn’t parked properly and i dont have to pay for the repair cost?
