First of all, the Kejara System or the Demerit system adopted by the Road Transport Department at Putrajaya, mainly involves 2 categories of drivers only.
i) “P” or new drivers who have just received their licenses.
ii) Competent Driver Licenses (C.D.L.) or passed drivers.
Learners Driver License or “L” drivers, being temporary license holders are not involved in this system at all.
In an earlier article on the Kejara System, I have promised to talk about traffic offenses and the demerit points which are accorded to drivers.
All in all, 18 important offenses are involved. I believe drivers would be rather eager to know what these offenses are. The offenses together with the demerit points, which would be awarded are as follows:
1) 15 demerit points.
5 traffic offences are accorded for various traffic offences. Amongst them are:
a) Driving under the influence of alcohol or drugs
b) Dangerous and careless driving.
c) Driving with undue care and in inconsiderate manner.
d) Speeding or road testing activities.
e) Without due good reasons, refusal to provide specimens of breath, urine and blood to the police when requested to do so.
2) 10 demerit points.
For this, 10 demerit points are involved. Basically, it involves 3 main traffic offences. They are:
a) Failure to obey traffic lights.
b) Failure to install P stickers both front and back of one’s vehicles.
c) Exceeding a speed limit of more than 40 km/h in a designated road.
3) 8 demerit points.
Next under the Kejara System, offences which are deemed as important and therefore should not be violated by a driver are given 8 demerit points. What are the offences are we talking about? They are:
a) Speeding exceeding 26 km/h – 40 km/h at a designated place.
b) Offences involving overtaking and obstruction whilst in the process of overtaking.
c) Not giving way to ambulances, fire brigade, customs, police and J.P.J. vehicles.
d) Offences by drivers at zebra or pedestrian crossing areas.
e) Offences which involves non adherence to driving on the left hand side of the road.
f) Failure to stop at junctions.
g) Careless and not giving due care to the control of vehicles.
The above are 7 traffic offences which drivers are advised to keep a look out for.
4) 6 demerit points.
Exceeding speed limit at certain designated areas of speed of between 1 km/h – 25 km/h will get you a 6 point penalty.
5) 5 demerit points.
I can think of 6 offences which carries 5 demerit points. They are:
a) Using a motor vehicle at road block areas.
b) Disobeying directions and traffic signs.
c) Using worn out tyres.
d) Overtaking at double lines.
e) Failure to adhere to rules and regulations pertaining to P drivers under Kaedah 15A (Kaedah-kaedah Kenderaan Motor (lesen Memandu) 1992.
f) Failure to bring along one’s driving license while driving.
g) Failure to adhere to the requirement of alcohol content of breath, urine and blood being at 0.00 level.
Keeping an eye on the above important traffic offenses will g along way to prevent drivers getting demerit points.
In the process, you wouldn’t have to worry about your driving licenses getting black listed by the J.P.J. authorities. And you will have no problems at all getting your driving licenses renewed or your road tax issued when the time comes.

Yes, you are absolutely right. Yes, you are not allowed to drive if you consume alcohol.
Hello Cikgu Yap! Sorry if this sounds like a dumb question but I just want to make sure.. I don’t really get the part “Exceeding a speed limit of more than 40 km/h in a designated road”. Does it mean
1. Offensive to drive over the speed limit by as much as 40 km/h (e.g. limit is 90 km/h & I drive at 130 km/h)
or
2. offensive to drive over the speed limit regardless of how much when the speed limit is over 40 km/h (e.g. limit is 90 km/h & I drive at 95 km/h)

40 km/h means you are not allowed to go more than the above speed limit. Even if you are travelling at 45 km/h, you have committed an offense.
Hey Cikgu Yap, I just got into an accident 3 hours ago, and i’m on my way to report it in a short while. The situation is like this: I drive a kancil, was going back to my house using Federal Highway, and got into an accident with a Toyota Vios on the right lane.
My bumper knocked against his and his bumper dropped. The damage was moderate. And the problem is, i am a P license holder.
Will i get suspended?
As your accident has not been settled amicably, make a police report. Your incident, being a minor one, demerit points, in my opinion, will not be enforced.
I would like to know, what happen if my car is being used by my sister who only has p licence and she got 2 summon within 1 week for speeding. Will my licence be suspended? Can i transfer the point to her? Thanks for your advise.
If your sister is issued the summons, then she’ll be charged for it. In cases whereby a speed trap is involved, where the driver is not ascertained, then the owner, that is yourself, will bear the consequences.
Hi, I would like to seek for your advice regarding the demerit points as I am new to Malaysia. Recently, I got a notice from JPJ and they were claimed that I / the driver at that time failure to obey traffic lights and asking me to go the office together with the documents that they mentioned in the notice. In this case, will my licence be suspended? or i pay the summon ?

Hi Cikgu Yap, I am P license holder which probationary period will be ended in this November. I got caught by AES in July and I suspected myself failed to obey traffic light today (which traffic lamp showed yellow light and I did a U-turn, I thought it should be legal act?), I paid the AES summons on the next day I received JPJ letter, will by license suspended due to demerit system?
Only time will tell if the demerit points will catch up to you.
Hi , I would like to ask if my friend who has a P license and got a summon for speeding a month ago , will my friend get demerits for it ? And if yes , does he still gets the demerit if he goes to pay the summon ?
If applied strictly, P drivers who get 10 demerit points will lose their licenses.
So does it mean that even if he paid the summon , he’ll still get demerits ?

Sir, I did the alcohol test at police station, the reading is 176…what will happen as I m P license holder? Some more my P is going to expire next month 30/10/2014. Quite worry about this matter…
Assuming you are found to be in the wrong, the demerit system might affect your P license. However, only time will tell if action will be taken against you.

I am a P license holder and recently met with an accident. I was climbing the slop at a parking bay when there was clear traffic and all of a sudden one car came at a speed and hit my car. We both went and met traffic Sargent, he said the fault is on my side, but I explained to him that I stopped and watched the traffic and then I started to climb and there was no vehicle, after I started to turn the vehicle I was hit by the other car. I am confused with Sargent’s explanation to me. Please help me with your views !! thanks

31 Ogos 2015, saya dan rakan saya (Jammy) telah pergi bersiar-siar, disebabkan waktu semakin larut malam (2.30pagi), saya sangat mengantuk dan meminta rakan saya, Jammy utk memandu kereta saya. Malangnya, polis trafik telah membuat road block, dan meminta lesen memandu Jammy. Malang sekali lagi, Jammy tiada lesen memandu, dia hanya ada lesen memandu L. Untuk mengelakkan disaman dengan lebih teruk lagi, Jammy terus mengaku tiada lesen, dan tidak memberitahu, dia mempunyai lesen L. Selepas berbincang, polis berkenaan bersetuju menukar kesalahan Jammy kepada “lupa membawa lesen”. Akibat risau yg teramat, saya dan Jammy terus ke balai polis utk membuat pembayaran saman, tapi pejabat tutup. huhuhu..
Yang saya risau sekarang,
1.adakah lesen L Jammy akan digantung atau terbatal?
2. berapa bayaran saman dikenakan ke atas kesalahan lupa membawa lesen memandu

I recently bumped into my friend’s stationary car at the back area while I reversed. She has a small scratch while my side front bumper had some paint scraped off. Both of us are planning to report it to the police station within 24hrs so she can claim my insurance. As I am still a P-license holder, how many points do you think I will get deducted as I understand I only have 10 demerit points. I understand I will also be fine rm300 but will my friend get fined too? Please advise, thank you.
For small dents and scratches, you don’t have to claim your insurance.
If you do, you are going to loose your NCB. Just pay for the repainting job and be done with it.

If the other party made a police report and your are found guilty, it is a possibility you will get the demerit points.
Hi cikgu yap, i just got roadblocked by the jpj today and got a saman of not paying road tax, not paying insurans and the one that im worried the most: not placing the 2 p stickers front and back, i got this saman at 30/8/2018 and my license end at 02/04/2019. The car is not mine as i borrowed it from my uncle, so the roadtax and insurans have to be paid for the saman asap but what about my p stickers fine? Should i pay for the saman relating to the p ticket that is due to 2/12/18 or cn i wait till my license end (which i dont think is possible)? Can i still drive? Is my p license revoked? Do i really still hv to resit for the test? When can i have to sit for the test if my license is really revoked? How will i know my license is really revoked or not? Pls help me, im very scared….
