Minor car accident

The following comment was posted by Ms Ho back in 3rd June 2015.

She had a minor accident with another car and wanted to know if it is best to claim from her insurance company.

Minor car accident with a Toyota Vios

Dear Cikgu Yap,

I had an accident this evening after work and I’m at fault.

I hit a Toyota Vios’ right bumper and it caused quite a dent on the bumper.

The lady driver was in shocked and so was I.

I honestly thought she would have moved already as the car on the right lane are still a little far and not driving too fast.

Ended up I bumped into her car.

We weren’t sure what to do and I felt so guilty as the lady needed few seconds to calm down plus my car only suffered very tiny scratch (like 5-10 cents tiny).

She asked if we want to go to lodge a police report or settle outside, meaning I will pay for her repair.

I opted to pay for the repair but the lady driver said that she will bring her car to Toyota service centre to get them to check and provide a quotation.

And she said she will discuss with me on the quotation and from there, we decide whether I’m ok with the price.

We took photo of our cars and our identity cards, exchanged contact numbers (plus we worked at the same office area) and agreed to meet up once we have agreement on the repair cost before parted quite amicably.

So my questions are, since we agreed to settle this within ourselves:

1) Do I pay exactly the price quoted by her Toyato service centre or is it something that I can negotiate if assuming the price is too much for me to handle?

2) Do I still need to inform my own insurance about this accident as we’re settling ourselves and though there’s really nothing to fix except for that tiny scratch on my car?

If yes, will I be penalized by having to pay higher insurance next year or losing my NCB?

Appreciate your advise as this is my first accident.

My response to Ms Ho

The other party’s Vios appears badly damaged.

Wouldn’t it be better to make a police report and claim insurance instead?

Anyway, if the other party’s quotation is not acceptable for you, you could negotiate with her for an amicable solution.

Finally, it is you who makes the final decision whether to accept it or not.

If in any eventuality, a police report be made, the inform your insurance company.

Of course, in pursuing such a stance, you will lose your following year’s NCB and insurance costs will therefore become higher.

But don’t forget, repairs of the Vios you hit will be borne by the insurance company.

Flood Water

In my last blog post, I wrote about what you should do when driving your car over flood water. In today’s post, I‘ll be writing about car insurance particularly, who pays for water damages caused by flooding for your car. To put it simply, will the auto insurance company pay for your vehicle flood damage?

The answer to the above question is, unfortunately, NO! Not all insurance do. Only 1st Party or Comprehensive Policy.

My association with many mechanic friends over the years, have led me to understand some important things. They are, amongst other things:

i. For a car engine not to stall, the engine timing should ideally be more or less perfect.

ii. In manual driven vehicles, the ignition coil (in older mode) or the contact point should not come into contact with flooded waters. In newer vehicles, the above 2 parts are replaced by electronic starter units.

In short, it is contention and belief that as long as the above important parts are free from flood waters, you posses a very good chance of getting your vehicle across flooded waters.

Drivers and motorists, what must they do when they came across a flooded area?

In fact, there are 2 pertinent things that one should try to do. First is to get across a flooded area safely. Secondly, do not to allow one’s car engine to stall!

Next, we come to the hypothetical question of what if your vehicle should suffer from flooded waters? Will insurance coverage pay for the damage?

In reality, I am rather certain most Malaysian motorists or drivers do not know the answer to the above question. The Road transport Department or the Jabatan Pengangkutan Jalan (JPJ) makes it compulsory for all vehicles to be covered with Third Party or First Party (Comprehensive) risks before road taxes are issued.

I researched into the question of insurance coverage during floods, has led me to understand that a Comprehensive or 1st Party coverage is part of your automobile policy. And the good news is, your vehicle, which has been damaged by flood waters is therefore covered!

However, if unfortunately you are covered only by Third Party liability coverage, No, you’ll not be so lucky! In short, 3rd party insurance does not cover flood damages!

It is therefore no wonder, that if your car is under hire purchase financing, banks will always insist that your car is under comprehensive or 1st party insurance coverage.

In Malaysia, comprehensive insurance policies are slightly more expensive than 3rd party policies. Is the 1st party insurance premium worth your peace of mind?

You will have to think about it carefully. Then make a decision as to which type of risks you would like for your vehicle. If you have an older car, you may only want a 3rd party coverage for it.

What do you do if you are unfortunate to be involved in a flood or a storm?

The steps you are advised to take are as follows

i. Call your insurance agent immediately.
ii. Make an assessment of the damage.
iii. Take photos of your car.
iv. The above documents are extremely important
v. Do whatever you possibly can to comply with your insurer’s requirements.

In most cases, your insurance company will normally send an adjuster to your home or your workshop. If the damage to your car exceeds your car’s worth, then you can elect to take an option or payment. In Malaysia, this is known as Total Loss amongst insurance circles.

Is what is practiced in other countries, like England, Europe and America similar to those practiced in Malaysia? It is my contention and belief that the laws remain the same. After all, laws are laws. There shouldn’t be any differences or discrepancies.

However, to be on the safe side, I will look up my long time personal friend, a Mr. Ah Peng, 50, of Messrs Goh Brothers Insurance Agency in Klang to seek his opinion later.

So much for the question of flood damages in this article. By reading this short yet informative article, it is earnestly hoped readers of this blog will be better informed regarding flood damages.

Insurance claims are not the only problems a driver faces should he be caught in a flood. Your vehicle will most probably incur a few mechanical problems as well.

Lately, most insurance companies have refused to issue 3rd party coverage for old vehicles which are 10 years or more old. This has led the authorities, namely Bank Negara to set up a special group of insurers called the Malaysian Motor Insurance Pool, hereinafter known as the “Pool”, to underwrite 3rd party insurance coverage for old vehicles which are 10 years or older.

For readers’ information, the Malaysian Motor Insurance Pool, or the “Pool”, was essentially set up to cater for vehicles which no insurance company were willing to insure, as the government had agree to allow them (old vehicle) to be on the road and 3rd party insurance was something “mandatory”.

It should also be reiterated again that the “Pool” eventually sustained losses leading to additional premium being loaded onto the consumers. Bank Negara’s latest directive to all insurance company recently has indeed been long overdue. Nevertheless, it is believed that all consumer bodies, like C.A.P. and political leaders from both the government side and the opposition parties will surely welcome its move.

The MCA president, Datuk Seri Dr. Chua Soi Lek, were amongst one of the earliest people to welcome Bank Negara’s latest directive to insurance companies. Owners of motorcycles and cars which are more than 10 years or older, will now be able to secure 3rd party mandatory insurance cover for their vehicles.

Bank Negara’s directive to all insurance companies takes effect immediately. Insurance companies are no longer allowed to imposed “loading” fees, which previously amounted between 200% to 300% to be imposed upon old cars.

Besides excessive loading fees mentioned above, insurance companies have been reported to have insisted upon the purchase of life policies and other perks such as Personal Accident Policies (PA) being purchased. However Bank Negara’s latest announcement on 3rd party insurance coverage for old cars comes with a “catch” attached. As such, motorists of motorcycles and car owners should not become to elated too soon. As the famous English proverb goes, “we are not out of the woods yet”.

If one were to read between the lines, it says explicitly, fees cannot imposed up vehicles which are “road worthy”. And the pertinent question which most owners of old vehicles would like to ask is, what actually represents “road worthiness”?

Bank Negara has said, vehicles which are more than 10 years or more will be required to under an annual road worthiness inspection exercise to be conducted by the Puspakom authorities. With the above said requirement, it looks as if the government has reverted back to its last decision which it made some 6 months back. It then allowed old cars more than 10 years old to finally be used on Malaysian roads. The “reprieve” it looks as if, has finally been withdrawn again! We are now back again at square one, so to say.

Motorists will have to wait further to know if the authorities will implement the mandatory road worthiness exercise which has been once again imposed upon vehicles which are 10 years old and older! Still harping on the issue of 3rd party insurance for old cars, to be fair to the insurance companies, premium rates for 3rd party has not been raised since 1978.

Considering insurance companies current profits, it is believed that, they are still capable of making a comfortable profit. They can well afford to use profits from comprehensive policies to offset 3rd party coverage for old cars.

If you have been working in a company or an establishment for 10 or more years, you’ll be termed as an experienced member of the staff. There exists a saying in the English Language which reiterates, “Old is Gold”, or is it?

However, if you are a motorist, irregardless of whether you are driving a car or you own a motorcycle, and if you happen to want to renew either one of the above vehicles’ road tax, then you would surely face immense difficulty when attempting to secure their road tax annually. This is the situation in Malaysia lately.

For readers’ information, owners of old vehicles, which are 10 years and over, have been facing much difficulty in trying to secure 3rd party insurance coverage for a number of years now. Insurance coverage for an old vehicle which is more than 10 years old or more, used to cost approximately less than RM100 two or three years ago. It must be borne in mind that the above calculation comes with a 55% NCB (No Claim Bonus) discount.

The above vehicle, referred to is a 1998 Proton Iswara 1300 c.c. model. This year, insurance companies have insisted that the above vehicle purchase a mandatory RM14,000 1st party insurance, costing between some RM700 – RM800. The above Proton Iswara currently is valued at no more than RM3000 to RM4000.

As an owner of the above old vehicle, it is my opinion that the Insurance Company’s demands tantamount to day light “ransom” upon owners of old vehicles. It should also be kept in mind that most owners of old vehicles are made up of consumers of the lower income bracket and also pensioners as well.

To illustrate the predicament currently faced by owners of old vehicles further, vehicles which are aged 10 years or more are termed as “displaced vehicles” or in other words, “high-risks vehicles” by insurance companies. To regard vehicles which are more than 10 years old or more as such, is not only unfair but also represents a very “irresponsible” comment.

I hold onto this contention because to date, there has been no concrete evidence whatsoever to support the premise as such.

Vehicles which are 10 years old or more are mostly used by owners who are mostly village or kampong folks, pensioners and the lower income group. Such vehicles are essentially used to conduct shopping errands, carry out small time businesses like operating “nasi lemak” and “goreng pisang” stalls. Such cars normally travel slowly and I do not believe that such cars or vehicles are used to travel long distances.

Any old vehicle owner who contemplates to drive his old “jalopy” upon highways and expressways must surely be out of his mind. To do this would be tantamounting to invite “troubles” and “problems”. With such reasons to back up or oppose old vehicles as high risks, insurance companies insistence to deem old vehicles as such is totally uncalled for and unfair.

Let us now consider why purchasing second hand vehicles is better than purchasing new vehicles. In purchasing second hand vehicles, the 7 things to consider are:-

1) Smaller hire and purchase loan.

To secure second hand vehicles one requires only limited amount of finance. Compared to buying a new vehicle, which can sometimes be quite costly.

In buying second hand vehicle, the owner has to stump out a lower amount of money, or to take a lower amount of loan for the car.

2) Cheaper insurance cover.

Second hand vehicles only require third party coverage which is cheaper. Third party insurance cover for second hand vehicles are much cheaper when compared to first party ones

3) Slower value depreciation.

Second hand vehicles are said to suffer from lower depreciation costs as compared to new vehicles.

4) Higher maintenance required.

The necessity to change certain important parts of the vehicle such as clutch, timing chain or belt, and engine wear and tear. Such repairs can sometimes be rather costly affair.

5) Less efficient.

Second hand vehicles can sometimes be unable to provide efficient service. They tend to breakdown more often as compared to new vehicles. They are, infact less reliable.

An owner of a second hand vehicle, you will undoubtedly have to spend quite a sum of money on the upkeep of second hand vehicles.

6) Wear and tear issues.

Second hand vehicles are also said to undergo risks of corrosion. In such cases, its body work will have to undergo welding repairs from time to time to keep it in proper, working condition. A second hand car, will also have to repainted from time to time. All these, costs money to upkeep.

7) Higher fuel consumption.

Some second hand cars can sometimes be said to be unable to provide you good consumption. Consumption can at times be heavy due to the carburetor system having undergone much wear and tear.

In my last blog post, I wrote 5 good reasons why you should buy a new car versus a used car. But behind all the pros, there are also some cons as well.

In this post, I thought of writing a short post on 3 disadvantages of buying a new car.

1) Higher deposit required.

To purchase a new car, a person will obviously require a higher deposit or a larger loan. Interest on the car will definitely be higher, thus making the vehicle purchased costlier in the long run.

2) New car more likely being stolen.

New cars are more susceptible to being stolen as compared to second hand vehicles. An owner will then have to insure it for a higher sum of insurance. In the end, owners of new vehicles will have to bear higher financial costs.

3) Higher and faster depreciation.

Besides possessing a higher resale value, a new car also experiences a “depreciation” drop which can amount to anything from 25 – 30 percent initially. Compared to second cars, new cars which suffer from depreciation drop is normally borne by the first owner.

Should you now buy a new or second hand car? After considering all the advantages and disadvantages, you can now make your decision.

The Barisan Nasional, which consists of various political parties such as UMNO, MCA, MIC and Gerakan and the opposition which is made up of P.K.R, D.A.P. and PAS, recently collaborated with each other in Parliament. For the first time in the history of the Malaysian Parliament, the above two parties heavily criticized the vehicle insurance scheme currently offered to the Malaysian motoring public.

Datuk Mohamed Aziz (B.N. Sri Gading) says he sees no sense why insurance companies should charge such exorbitant rates for third party insurance for vehicles which are more than 10 years old.

Owners of old vehicles, who are made up of mostly village folks and pensioners, are badly affected by the insurance companies’ refusal to cover old vehicles.

A few years ago, third party insurance was within the ambit of RM100 to RM150 only. Believe it or not, this year, 2011, my wife’s Proton Iswara, had to fork out some RM380 for a RM14,000 first party policy. The above amount was arrived at even after a 55% N.C.B. deduction was made. For your information, the above vehicle is a 1993 model. Its value in the market today, is no more than RM2,000 to RM3,000.

Insurance companies were only willing to insure the above vehicle for a sum of RM14,000 first party insurance coverage. What I would like to inquire is, if in any eventuality, the said vehicle is stolen or lost, are the insurance companies willing to compensate or reimburse the owner an insured sum of RM14,000?

According to legal sources, a vehicle which is legally insured for a sum of RM14,000 should infact be paid the sum above. However, whilst speaking to my friend and one of Klang town’s top insurance agents, Mr. Goh of Goh Brothers Insurance agency, I was told by Mr. Goh himself that there is a clause in the motor insurance agreement which specially reiterates that insurance company can replace a RM14,000 vehicle insured, with a similar make or model of the vehicle insured.

Should owners refuse to accept the insurance company’s offer then the only alternative is for one to engage a lawyer to challenge the insurance company’s offer. Whatever the consequences, it would be a tremendous hassle indeed.

The third party insurance problem has come to a stage whereby the government is unable to come up with a favourable decision to aid the poor third party vehicle owners.

A few months ago, the government, with Bank Negara’s assistance, announced that anew insurance company which is to be made up of the government and private insurance companies is to be set up. It was also made known the “premiums” charged by the above new company will be acceptable to all motorists.

It now looks as if the above proposed company has erupted up in smoke, as far as third party motorists are concerned.

Datuk Bung Moktar Razin (B.N. Kinabatangan) implored that Parliament should monitor the operations of insurance companies which he claims would happily charge consumers for the slightest of things. Insurance companies had not made it easy for policy holders when they had to make damage claims.

D.A.P’s Bandar Kuching Parliamentarian, Chong Chen Jen, said policy holders were “forced” to purchase personal accident insurance before they could buy third party policy for their old vehicles. Otherwise, the companies will not allow them to purchase the required insurance.

If previously, they were supposed to pay just RM70 to RM80, now they will have to fork out more than RM200. Mr. Chong asks, “How could Bank Negara be so blind, as not to notice what the insurance companies are doing.”

The problem of motor insurance does not involve third party insurance only. I have been told that insurance coverage for other vehicles such as school buses, small lorries and even 3 ton lorries, which are usually used to ferry goods, face similar problems such as that faced by vehicles that are over 10 years old.

According to a Mr. Goh, the manager of Goh Brothers Insurance Agency in Klang, his business investment performance has been badly affected. Mr. Goh claims he is unable to provide the necessary insurance to his clients. They are now unable to obtain the necessary insurance coverage and this has resulted in business being affected badly.

Looking at the overall situation, it appears that third party insurance coverage for old vehicles which are 10 years and above, will continue to be a major headache to many Malaysian in the coming months and may be even years ahead.

Unless Bank Negara itself and the government as a whole take immediate actions to rectify the dire situation, this problem will continue to be raised by many political parties in the forth coming general election soon. It would, without doubt, be a hot topic of discussion.
